A few key points on our states AMBER Alert plan....

-The criteria was changed in 2017. It now mandates that an ABDUCTION has occurred to have an alert sent out.

-The AMBER Alert is considered for children under the age of 18.

-there needs to be NO LICENSE PLATE to set off the cellular signal, or WEA (Wireless Emergency Alert).

-There is only one WEA sent out. The AMBER Alert does not get cancelled over a WEA.

- The WEA message only includes 90 characters and cannot push a photo or a link for more info at this point.

- There is no waiting period for the AMBER Alert, but the request must come from the law enforcement agency investigating the abduction.

- Parental kidnappings are considered, but like other AMBER Alerts, the child needs to be in imminent danger of great bodily harm, or death.

- If the missing child does not fit the AMBER criteria, the case may be considered for the Endangered Missing Advisory, or EMA, which is an alert for endangered missing people of all ages.

A word about parental abductions:

Our states’ AMBER Alert criteria requires essentially two things. An abduction- and an imminent threat of great bodily harm or death to a child under the age of 18.

That being said- parental “abductions” happen every single day in our state. Most are due to a custody dispute and are a friend of the court issue. Most do not have any threat to the child as the taking parent wants PARENTING TIME, not to hurt or to kill the child.

Yes- we are aware that some parents out there are not fit for parenting and that’s why CPS gets involved to remove a child. Sometimes parents catch wind of this and flee. While this is concerning- it’s most likely not an AMBER Alert situation unless there is a threat to the child that fits the criteria for the AMBER Alert.

Yes- we are aware that some parents do kill their children- and WE DO issue on parental abductions that have had force used or threats made to hurt to the child, or a history of abuse and neglect TO THE CHILD.

If the case doesn’t meet the AMBER Criteria- it usually gets the Endangered Missing Advisory- or "EMA", which was created for just these instances. Endangered runaways, adults missing under suspicious circumstances, dementia patients and elderly drivers all fit the EMA criteria.

So the next time you see a child is missing and wonder “where’s the AMBER Alert”? Rest assured, we have likely already gone over this with the agency and found that it did not fit the criteria.
