Josef made important, impactful photos. He recorded history. He retained control of that work. Now he finds a home for them to reside & educate long after he's gone.

This is why archives matter!!! Don't think your images won't retain historical value. Just in the 21st Century alone we've all witnessed much history from 9/11 to endless wars, climate destruction, a pandemic we hope never to see again, civil rights struggles and incredible homelessness to name just a few.

Politico sold to German publisher Axel Springer

Here's the thing: I get a lot of emails & requests for help and I try my best to help everyone in whatever way possible. But there is a universal pattern to thr issues at hand.

Freelancers mostly don't want to deal with the problem, they want to deal with the symptoms as they arise on a case-by-case issue. Consequently, many spend their time seeking care/help for symptoms instead of making a concerted effort to understand the root issue that causes the problem. In other words, if you're dealing with a chronic cough from smoking, do you seek help for the cough or do you attack the root problem which is smoking?

Today's news of Politico being bought by German media company Axel Springer is a perfect example of this. We'll see what happens with any contracts that will likely be forthcoming, but I would expect changes.

I warn often about contractual language issued in photo contracts but the overall interest in learning how to analyze contracts & the impact they have on freelancers is not nearly as strong as the interest freelancers have in dealing with the immediate symptoms of the contract. Example: When I read or hear from people that they think their images are being used without permission but then discover they provided the use when they signed a contract.

In another example, if a "brand" such as Sports Illustrated or ESPN uses your images in ways you think are an infringement (but almost assuredly aren't), the root cause is the contract; the symptom is extensive use of your images without payment. Which one are you spending time dealing with?

Freelancers should take a vested interest in protecting their livelihood and to do so means attacking the root problem which is the contracts issued by large media corporations that erode freelancers' image rights. Otherwise, freelancers are dealing with the symptoms like a smoker deals with the cough.

I go into the move to "brand use" in my book and detail at length how the 2016 Sports Illustrated rights issued contractual language that wrapped rights into a broad "brand" use instead of rights to the specific assigning publication.

The more mergers and acquisitions made by media corporations, the more you can expect to see your image rights extended to a growing network of "brands" under the corporate umbrella.

Will That College Degree Pay Off?

"If a student is interested in a field that tends to have lower earnings, keeping borrowing costs down is important."

Think before you dump $60k/year into a private university photography/photojournalism program.

If you decide to attend a private institution with a much higher annual cost to attend (computing beyond just tuition), then be DAMN SURE the program has a high national profile with a substantial proven track record of graduates excelling in the field. Otherwise, you're putting yourself in a deep financial hole that will weigh on you for decades.

Thanks for taking a moment to view my work and background. The Business of Photography Workshop developed as an offshoot from years of navigating the freelance world. I’ve provided visual services to editorial, corporate, non-profit and advertising clients worldwide since 1991. I am based in Los Angeles, California and in addition to shooting, teaching my workshop and consulting, I work as an adjunct professor at California State University, Northridge.
