About a year ago, someone made an anonymous Facebook post about Heritage Tavern, a bit of gossip overheard from a cater waiter.

“Heard from someone who did a catering event for Heritage that after the event, they were told … the restaurant was ‘keeping the tip,’” the person wrote.

That post on Madison Foodie, dated Oct. 3, 2024, is referenced in a class action lawsuit brought against Heritage Tavern on behalf of a former server, Florence Dieter, and her colleagues. Dieter is currently the only named plaintiff.

The complaint, filed in federal court last December, outlined allegations that Heritage Tavern regularly withheld server tips to cover business operations, set up an “invalid tip pool arrangement” with kitchen, support and bar staff, and failed to pay correct overtime wages.

In March, Fox and Bird, LLC — the legal name of Heritage Tavern — filed for Chapter 11 bankruptcy, citing Dieter’s lawsuit as the primary reason for doing so. This type of bankruptcy can involve restructuring finances to allow a business to pay down debts over time.

Both cases are ongoing. Heritage Tavern does not intend to close the restaurant.
