Federal agents from the Department of Homeland Security have visited some Somali businesses in the Twin Cities.
According to a public statement from Secretary Kristi Noem, federal agents are conducting operations in Minneapolis as part of a broader investigation into Somali-owned businesses.
For business owners, it helps to know how to handle a visit like this.
If federal agents come to your business, you can ask the purpose of their visit, which agency they represent, and to see their credentials.
Most importantly, limit conversations.
You are not required to answer substantive questions without an attorney present.
Disclaimer: I am not a lawyer. This is general information, not legal advice. Consult an attorney if you need legal guidance.
You may tell agents that you want counsel before answering questions or providing documents. If you do not already have an attorney, you can ask for time to contact one.
Agents do not have an automatic right to enter nonpublic areas of your business.
If they do not have a warrant, you can politely decline entry beyond public spaces.
If they present a warrant, read it carefully. Confirm the address, the scope, and exactly what they are authorized to review or seize.
If they present an administrative subpoena or notice, that does not usually require immediate, on-the-spot compliance.
Agents may not intimidate or coerce staff.
Employees also have rights, including the right to remain silent and the right to speak with an attorney.
Do not instruct employees to lie, conceal information, or destroy records. That creates serious legal exposure.
After the visit, consult counsel to review next steps, compliance obligations, timelines, and communications.
If the situation is likely to become public, seek communications advice early so you do not unintentionally spread fear or misinformation.
One final point: A visit does not mean wrongdoing.
Agencies often conduct broad sweeps, audits, or preliminary inquiries that never lead to charges.
When business owners know their rights, these visits are often brief and uneventful.
