“Can Halloween accidents be covered by Personal Injury claims?”
It’s a good question, and honestly, it depends on how the accident happened.
Here in Louisiana, personal injury cases are based on fault.
That means if someone’s carelessness caused an accident, like a distracted driver, poor lighting, or unsafe property, they may be legally responsible for your injuries.

Even if you were partly at fault, you can still recover damages.
Louisiana follows a comparative fault rule, which simply reduces your compensation by your percentage of fault, but doesn’t erase your rights completely.
For example:

So yes, in many cases, Halloween accidents can be covered.
