អ្នកនយោបាយថៃ និងមេទ័ពថៃ បានបង្កើតធាតុផ្សំគ្រប់គ្រាន់ដែលអាចនាំពួកគេទៅកាន់តុលាការ ICC ហើយ
ប្រសិនបើបង្ហាញឱ្យឃើញសកម្មភាពខាងក្រោមរបស់ប្រទេសថៃ អាចត្រូវបានចាត់ថ្នាក់ជា ៖
• ឧក្រិដ្ឋកម្មសង្គ្រាម
• ឧក្រិដ្ឋកម្មនៃការឈ្លានពាន
• ការរំលោភលើច្បាប់មនុស្សធម៌អន្តរជាតិ
នេះ អាចបង្ហាញថា មេដឹកនាំនយោបាយ ឬយោធាថៃ ត្រូវបានយកមកកាត់ទោសនៅចំពោះមុខតុលាការយុត្តិធម៏អន្តរជាតិ (ICC) ហើយ។
ខាងក្រោម គឺជាសកម្មភាពដែលថៃ បានធ្វើមកលើប្រទេសកម្ពុជា ៖
ទី១-ការបំពានច្បាប់មនុស្សធម៌អន្តរជាតិ ៖
ការប្រើប្រាស់គ្រាប់បែកនៅតំបន់ជនស៊ីវិល ឬបិតិកភ័ណ្ឌពិភពលោក គឺជាឧក្រិដ្ឋកម្មសង្គ្រាម។
ទី២-ការប្រើប្រាស់អាវុធហាមឃាត់ ៖
គ្រាប់បែកចង្កោម ត្រូវបានហាមឃាត់ក្រោមអនុសញ្ញាស្តីពីគ្រាប់បែកចង្កោម (CCM) (២០០៨)។
ទី៣-ការឈ្លានពានរបស់រដ្ឋ ៖
ការឈ្លានពាន ឬប្រើប្រាស់កម្លាំងប្រដាប់អាវុធប្រឆាំងនឹងទឹកដីនៃរដ្ឋអធិបតេយ្យមួយទៀត (កម្ពុជា) ដោយគ្មានការយល់ព្រមពី UNSC គឺបានបំពានលើ UN Charter គឺជាអំពើឈ្លានពាន។
ទី៤-ការស្លាប់របស់ជនស៊ីវិលនៅកម្ពុជា ៖
ការកំណត់គោលដៅដោយចេតនា ឬការមិនយកចិត្តទុកដាក់ចំពោះជីវិតជនស៊ីវិល អាចនាំទៅដល់ការកាត់ទោសពីបទឧក្រិដ្ឋកម្មសង្គ្រាម ឬឧក្រិដ្ឋកម្មប្រឆាំងមនុស្សជាតិ និង
ទី៥-យុត្តាធិការរបស់តុលាការ ICC
• តុលាការ ICC មានយុត្តាធិការតាមពាក្យបណ្តឹងកម្ពុជា ព្រោះ ៖
• ប្រទេសកម្ពុជា គឺជារដ្ឋភាគី
• អ្នកនយោបាយ និងមេទ័ពថៃ ប្រព្រឹត្តបទឧក្រិដ្ឋនៅលើទឹកដីកម្ពុជា។
• យុត្តាធិការសកល ក៏អាចអនុញ្ញាតឱ្យប្រទេសផ្សេងទៀតកាត់ទោសមេដឹកនាំ ឬមេបញ្ជាការថៃផងដែរ។
ដល់ពេលដែល រដ្ឋាភិបាលយើង នាំពួកនេះ ទៅតុលាការ ICC ហើយ៕
Thai politicians and military leaders have created enough evidence to take them to the ICC
If proven, the following actions by Thailand could be classified as:
• War crimes
• Crimes of aggression
• Violations of international humanitarian law
This could mean that Thai political or military leaders could be brought to justice before the International Court of Justice (ICC).
The following are the actions that Thailand has taken against Cambodia:
1. Violations of international humanitarian law:
The use of bombs in civilian areas or national monuments is a war crime.
2. Use of prohibited weapons:
Cluster bombs are prohibited under the Convention on Cluster Munitions (CCM) (2008).
3. State aggression:
The invasion or use of armed force against the territory of another sovereign state (Cambodia) without the consent of the UNSC is a violation of the UN Charter and constitutes an act of aggression.
4-Civilian deaths in Cambodia:
Deliberate targeting or disregard for civilian life can lead to prosecution for war crimes or crimes against humanity, and
5-ICC jurisdiction
• The ICC has jurisdiction over Cambodia’s complaint because:
• Cambodia is a state party
• Thai politicians and military leaders committed crimes on Cambodian soil.
• Universal jurisdiction could also allow other countries to prosecute Thai leaders or commanders.
It’s time for our government to bring them to the ICC.
