Today marks my 25th year in entertainment. I began in the mainstream and walked away early when I realized I wanted ownership, control, and freedom. I’ve spent 20 of those years fully independent—learning hard lessons, gaining real wisdom, and building something lasting. What once cost me everything is now what artists pay me to teach them. Providing entertainment services as THE QUEEN OF SHADE since at least 2015, Duphot has a wide social media following, has created and made available numerous songs and over thousands of downloadable online videos, regularly provides live performances throughout the country and internationally, and sells clothing and other merchandising. In 2018 alone, Duphot received over 21 million likes on his Instagram posts. Bjorn Duphot has taken great care to protect and enforce his rights in THE QUEEN OF SHADE trademark, including having taken the steps to register it with the United States Patent and Trademark Office (hereinafter “USPTO”) for use on “entertainment services in the nature of live musical performances”; “providing a website featuring non-downloadable videos in the field of entertainment, namely, inspiration, music”; “sweatshirts and t-shirts”; and “coffee mugs” and taking steps to enforce the rights in such Marks against those whom damage the distinctive character of them. Notwithstanding that Bjorn Duphot is undeniably THE QUEEN OF SHADE and the Duphot Persona is a recognizable one in the relevant community.
