# New Smyrna Beach Man Plans Lawsuit After Alleged Police Tracking

A New Smyrna Beach man says he is considering legal action against the New Smyrna Beach Police Department after learning that photographs of his motorcycle were allegedly circulated during an internal affairs investigation involving a police officer.

The man, who requested anonymity and will be identified as "Chris," was involved in an internal affairs investigation that ultimately did not result in any criminal charges. According to Chris, he was later provided photographs depicting his motorcycle and believes the images were used by department personnel to monitor or track his movements without a warrant. The officer was the subject of the investigation, and he was solely friends with her.

The allegations come amid previous concerns involving the use of license plate reader data within the City of New Smyrna Beach. In a separate incident, records obtained from the Volusia County Sheriff's Office were reportedly used by members of the New Smyrna Beach Fire Department to review the movements of a fire department employee after the employee missed a training session.

According to records reviewed, employees of the Volusia County Sheriff's Office were disciplined for releasing the information. However, records do not indicate that disciplinary action was taken against the fire chief who obtained and utilized the data.

Chris says he is currently exploring legal options and intends to pursue a lawsuit related to the alleged tracking.

When requesting the documents, the city stated "Active Investigation" and exempted the reports.

This remains a developing story; we should have more details soon.

Public records request have been made to the agency. But each employee would have first hand knowledge of some of the questions we are asking.

We're learning that an Orange City, FL – Government Cop with a sketchy background is now currently on administrative leave.

We were provided with no details about the incident, but a source close to the department believed the complaint came from a fellow officer. We will have more information relating to this situation.

A couple of arrests that were featured on line was a family who was arrested on their own property for trespass.

The second arrest was a 60-year-old man who Neily was charged involved with was a man arrested for his son's warrant. The officers failed to read the warrant.

A school guardian assigned to Cypress Creek Elementary School has been trespassed from the campus following an incident that occurred on school grounds, according to a Port Orange Police Report.

This contradicts the release from the school, citing it was simply a parent involved in a disturbance.

The report states that on May 15, 2026, Port Orange Police
responded to Cypress Creek Elementary School, located at 6100 South Williamson Boulevard, after school administration requested that Sean Sheridan be issued a trespass warning.

According to the report, Principal Kania completed a Trespassing Affidavit requesting that Sheridan be prohibited from returning to the school property. The report references a "recent incident" that occurred on campus but does not provide details about the nature of the incident.

At this time, no criminal charges were listed in the report, and officials have not publicly released additional details regarding the incident that led to the trespass request. HOWEVER, they cited that when requesting other reports, they are an active investigation.

The trespass warning prohibits Sheridan from returning to Cypress Creek Elementary School. A message from the school indicated they were not renewing his job for the following school year.

Sheridan was forced to resign from the Port Orange Police Department in lieu of termination in 2014.

We attempted to get body camera footage from the December incident the city redacted nearly the entire footage, citing 'privacy." We have contested the redactions and are awaiting the attorney's review.
