Marcus had two choices. He could "check" his supervisor and lose the job by 5:00 PM, or he could get the shipment out and keep his weekend plans with his daughter. He realized that "winning" the argument meant losing his life outside those walls. He shifted his focus from his ego to his paycheck.

โœ… ATS Friendly: Many Applicant Tracking Systems (the software that "reads" your resume) can struggle with special characters. Using accents can sometimes result in your text looking like "๐’“?๐’”๐’–๐’Ž?" to a computer.

The CA Fair Chance Act limits what information employers can legally look at, even after a conditional offer is made!

Employers are legally prohibited from asking about or considering information regarding arrests that did not lead to a conviction, participation in diversion programs, or sealed/expunged convictions.

If the record is sealed or expunged, it's generally off-limits and should not be used against you. Know which parts of your record are protected.

An employer cannot ask about or consider your criminal history (including through initial background checks) before they have made a formal, conditional offer of employment.

This is your biggest protection! It ensures that you are judged primarily on your qualifications and interview performance.

Why this matters: Your history is only considered after they have decided they want to hire you, and only if it directly impacts the job duties. Don't feel pressured to share details until that conditional offer is on the table!

Employers with 5+ employees cannot include a checkbox or question about conviction history on the initial job application. They must "Ban the Box".

This is critical! It means that your history should not even enter the conversation until after you've had a chance to demonstrate your professional value.

If you see a conviction history question on an initial application, know that it may be a violation of the CA Fair Chance Act.

What to do: Focus on landing the interview, not answering the box!
