A scammer doesnโ€™t need to hack your homeowners association. They may only need to look at information your community already makes available.

Meeting minutes, membership records and other association documents can contain details about the people who live in a community. Depending on the HOA and state law, some records may be available to association members while others could appear on an association website or another online system.

You probably didnโ€™t put the information there yourself. You may have no idea how much someone can learn about you. Yet a name tied to an address or community can give a scammer useful details for making a call or message sound legitimate.

โ€œPublicity is justly commended as a remedy for social and industrial diseases. Sunlight is said to be the best of disinfectants; electric light the most efficient policeman.โ€

Louis D. Brandeis wrote those words in 1913 in an article titled โ€œWhat Publicity Can Doโ€ for Harperโ€™s Weekly. The essay was later included in his 1914 book, Other Peopleโ€™s Money and How the Bankers Use It. Brandeis would later become a Justice of the United States Supreme Court.

For homeowner advocacy, we are making a very deliberate association with Brandeisโ€™s words:

From a homeowner advocacy perspective, you are fighting a structural uphill battle. Most HOA boards operate like miniature fiefdoms in the dark, violating their own bylaws, ignoring state laws, and treating homeowner inquiries as personal attacks.

When a board refuses to comply with association documents or state statutes, you cannot rely on them to turn on the lights. As a homeowner advocate, you must become the one who forces the illumination.

Here is how you aggressively deploy ๐—ฆ๐—จ๐—ก๐—Ÿ๐—œ๐—š๐—›๐—ง and ๐—˜๐—Ÿ๐—˜๐—–๐—ง๐—ฅ๐—œ๐—– ๐—Ÿ๐—œ๐—š๐—›๐—ง from the outside in to force a non-compliant board into accountability:

Sunlight is your tool to shatter secrecy and force the boardโ€™s actions into public view. Secretive boards thrive when homeowners do not know what is happening, do not know what records exist, or believe they are the only person asking questions. Change that.

Learn what association records North Carolina law and your governing documents entitle you to inspect. Request specific records in writing. Ask for meeting minutes, general ledgers, financial statements, contracts, invoices, bids and other records necessary to understand what happened. Preserve the request, the response and any refusal.

Take advantage of one of the many free blogging platforms and build an independent homeowner blog for your community. Organize information by topic: budgets, financials, contracts, meeting minutes, elections, assessments, rules, reserve funding, maintenance and association history. Publish the records you obtain, explain what they show, document unanswered questions and preserve important decisions in chronological order.

Facebook groups can be useful for organizing homeowners and distributing information, but they are terrible archives. Old posts disappear down the feed, documents become difficult to find, and years of association history cannot easily be organized by subject. A blog gives homeowners something much more powerful: a searchable, organized institutional record that exists independently of the board and management company.

You do not need your HOA boardโ€™s permission to research, document and publish truthful information about your own association. If the official record lives in the dark, ๐—•๐—จ๐—œ๐—Ÿ๐—— ๐—ฌ๐—ข๐—จ๐—ฅ ๐—ข๐—ช๐—ก ๐—Ÿ๐—œ๐—š๐—›๐—ง ๐—ฆ๐—ข๐—จ๐—ฅ๐—–๐—˜.

A board may find it easy to dismiss one homeowner as a โ€œtroublemaker.โ€ It becomes considerably harder when informed homeowners attend meetings together, understand the documents, ask specific questions and insist that decisions be made where homeowners can see them.

That is the power of Sunlight. What was once known by one homeowner becomes known by twenty. What was buried in a financial report becomes understandable. What was forgotten in old meeting minutes becomes part of the associationโ€™s history again. What was dismissed as an allegation becomes a documented fact.

When broad exposure is not enough to make a board comply with its governing documents or state law, switch on the Electric Light. This is the high-intensity spotlight aimed directly at the conduct.

Show the financial records. Do not merely say a decision was made improperly. Show the minutes, notice, vote or absence of them.

Then direct the Electric Light where it belongs. Put documented violations before the membership. Challenge directors through elections or lawful removal procedures. Take appropriate complaints to government agencies. Bring legal issues to attorneys. Put systemic failures before legislators. Give well-documented stories to journalists. When litigation is justified, give counsel an organized evidentiary record instead of a box of disconnected grievances.

Never underestimate the power of institutional memory. A board changes. A management company leaves. An attorney changes firms. Years pass. Suddenly nobody remembers why a special assessment was imposed, how a contractor was selected, what an engineering report recommended, why a rule was adopted, or who authorized an expenditure.

That is precisely why homeowners must preserve their associationโ€™s history themselves.
