Taking photographs and videos of things that are plainly visible in public spaces is a constitutional right, including transportation facilities, the outside of federal buildings, and police and other government officials carrying out their duties. However, law enforcement officers have been known to ask people to stop taking photographs of public places.0 While it may be legal to photograph strangers in public places, they could be trespassing as soon as the photographer steps onto private property. An artistic expression derived from an illegal act may not receive First Amendment protection.2 Photography gear is big, heavy, and can get in the way, so it's important to limit yourself to your camera, one lens, and a normal backpack-sized bag.3 Photographing a person in a public place, including children, does not require a model release or expressed consent unless the photograph will be used in advertising or stock photography.1 The Metropolitan Police state that members of the public and the media do not need a permit to film or photograph in public places, and police have no power to stop them from filming or photographing incidents or police personnel.
