After 31+ years of criminal defense litigation at the trial level I have leaned many "truths", but one of the most paramount is that if you are able to do it all "right" the first time then everyone can move on with their lives, be it for better or for worse. That said, and right up there with that fact is this: Even if you (meaning me, your friendly neighborhood criminal defense lawyer) do it all "right" the first time things can still go sideways at any point in time, be it before, during or even after the fact. Because of these (and other) realities there is a need for criminal appellate / criminal appeals counsel, and that's where Dan Tibbitt comes in....

Having graduated Columbia Law School The Florida Bar licensed Dan in 2004 and he took his first position right here in The 305 as an Assistant Public Defender in the Miami Dade County Public Defenders Office. After cutting his teeth in the trial pits Dan's big brain earned him a transfer into the PDO's Appeal's Division where he conducted research, authored briefs and argued points of law seeking to "right legal wrongs", to "correct incorrect rulings" to reverse convictions and to otherwise ensure that justice stood a chance. After nearly a decade and in 2013 Dan went into private practice, first with a criminal appeals firm but both then and since 2015 Dan has been the proprietor of The Law Office of Daniel J. Tibbitt, P.A., d/b/a Tibbitt Law, focusing upon appellate matters, be them either direct appeals, general appeals or other forms of post-conviction relief. Licensed in all Florida State Courts Dan has successfully argued cases in various Florida District Courts of Appeal and the Florida Supreme Court and he also handles cases on the Federal level. Most of Dan's clients are incarcerated people seeking to overturn or reduce lengthy prison sentences for serious felony crimes and he is directly responsible for successfully overturning uncountable convictions and sentences, including at least 10 life sentences. Dan not only serves his own clients but he frequently authors and submits "Amicus . Friend of the Court Briefs" on a variety of issues affecting Defendants, convicted individuals and criminal defense lawyers.

I first met Dan when he served as an APD and we've been friends for nearly two decades. He is most generous and reliable source of information, not just for me but for the entire FACDL / Florida Association of Criminal Defense Lawyers, and most especially for our local chapter, FACDL-Miaml. Whenever I have asked Dan has never failed to offer sage counsel and back in 2016 I was fortunate enough to have had a client who was able to retain Dan to sit at counsel table and "handle" legal argument on objections in a very complex RICO / Racketeering case wherein we knew that the potential for appellate issues would be both rife and widespread. In that case, and in his capacity as appellate counsel, Dan assisted in all aspects from Voir Dire / Jury Selection throughout the course of trial and then with regard to Sentencing (of the eight charges we secured 5 "Not Guilty" verdicts and "lost" three, ergo the need for a Sentencing Hearing).

Introduction now complete, Dan has kindly agreed to donate an hour of his busy Monday to share his experience and expertise with you, our beloved audience, and to discuss a wide swath of issues including but not limited to:
