USCIS Alters CSPA Age Calculation, Impacting Indian Green Card Applicants
WASHINGTON, Aug. 8 – U.S. Citizenship and Immigration Services will change how it calculates a dependent child’s age under the Child Status Protection Act (CSPA), a move expected to affect thousands of Indian families in the green card backlog.
Starting Aug. 15, 2025, USCIS will use the Final Action Dates chart from the State Department’s Visa Bulletin, replacing the more favorable Dates for Filing chart adopted in 2023.
The shift could cause more children of H-1B workers to “age out” upon turning 21, losing eligibility for permanent residency. Pending cases filed before Aug. 15 will remain under the old policy.
