Membership revalidation contrary to APC constitution, says Oshiomhole

The immediate past National Chairman of the All Progressive Congress, Comrade Adams Oshiomhole, on Tuesday, said the party's membership revalidation exercise called by the Interim Caretaker Committee is contrary to the party's constitution.

Oshiomhole said this while fielding questions from journalists shortly after revalidating his membership of the party at Unit 1, Ward 10, Iyamho, Etsako West Local Government of Edo State.

"APC is governed by a constitution and not by man. The constitution only provides for registration and I registered as a member of the APC in 2014 under the Interim National Chairman, Chief Bisi Akande.

"There is nothing in the APC constitution that says a member shall revalidate or renew his membership. Once you registered when you joined the party and you have not decamped, you are a member. So revalidation is strange to our constitution.

"I have only done this because I want peace to reign but in doing this, we have to be careful not to create constitutional breach," he said.

Oshiomhole, however, noted that between 2015 and now, people have exited from the party and others have joined while some have died, adding that it makes sense to review the register so that those who have decamped to APC will be registered while those who have left will be deleted.

"If you ask me as a foundation member, who has never decamped, to revalidate my membership, it is double registration because there is nothing like revalidation in our constitution.

"By asking me to revalidate my membership means I was not a member. So, I think the correct language should be either reviewing or updating because it makes sense to review voters register due to the new members that have joined or those that have exited," Oshiomhole said.

He said the party has been updating its register from time to time, noting that most of the governors under the party today became members following voters register update hence they were able to contest the governorship election under the party.

"So what this means now is that I have come here to do another registration but I insist that my registration never expired within the provision of the APC constitution," he said.

He said, "For me, I think we should just move on. I am happy I just did it but I don't need it because my membership has not expired and it can only expire when I decamp.

"History didn't just begin today. If we don't have a valid register, how did we conducted the congress in 2015 in which 16 million registered APC members voted to nominate President Muhammadu Buhari before the general election?"

He said at one of the party's National Executive Council meeting in Abuja when he was the national chairman, he had the honour of presenting membership card to President Buhari.

"I am a founding governor of APC, I am not a creation of APC. Some of those who are rowdy here and there came to join APC, but we formed the APC," he said.

President Muhammadu Buhari has accepted the immediate resignation of the Service Chiefs, and their retirement from service.
Those involved are the Chief of Defence Staff, General Abayomi Olonisakin; Chief of Army Staff, Lt-Gen. Tukur Buratai; Chief of Naval Staff, Vice Admiral Ibok Ekwe Ibas; and Chief of Air Staff, Air Marshal Sadique Abubakar.
President Buhari thanks the outgoing Service Chiefs for what he calls their “overwhelming achievements in our efforts at bringing enduring peace to our dear country,” wishing them well in their future endeavours.
The new Service Chiefs are: Major-General Leo Irabor, Chief of Defence Staff; Major-General I. Attahiru, Chief of Army Staff; Rear Admiral A.Z Gambo, Chief of Naval Staff; and Air-Vice Marshal I.O Amao, Chief of Air Staff.

Three major television stations have been sanctioned by the National Broadcasting Station (NBC).

Acting Director-General of the Commission, Armstrong Idachaba who made the announcement on Monday October 26 alleged that the Africa Independent Television (AIT), Arise Television and Channels Television violated the broadcast code, top of which is the use of unverifiable online video footages on social media.

The Nation reported that the television stations were accused of airing unverified images of the alleged shooting which took place at Lekki toll gate. The stations were fined N3m each over the coverage to the word.

Idachaba also disclosed that DAAR Communications will be fined separately for using an unverifiable news item on their fire incident report at the National Christian Centre. He also warned that this will be their last warning before a heavier sanction will be handed out.

Tribunal Nullifies Bayelsa Governorship Election.

The Bayelsa Governorship Election Tribunal has dismissed the election of Governor Douye Diri.

The Tribunal has ordered INEC to order a fresh election within 90 days.

In a split judgement of two-one, the three-man panel ruled that INEC does not have the power to disqualify any candidate for any election.

The verdict follows the petition by the Advanced Nigeria Democratic Party (ANDP) challenging the victory of Governor Diri in the November 19 governorship election.

The ANDP is claiming that the party was unlawfully excluded from the election.

But the Independent National Electoral Commission (INEC) in its argument said that the party’s Deputy Governorship candidate was 34 years old as at the time of nomination and therefore did not qualify to contest the election.

ANDP told Justice Yunusa Musa who is delivering the lead judgment that its initial Deputy Governorship Candidate, David Esinkuma was duly substituted by the Party within the allowed time frame, following the notification from INEC that he’s under-age.

Justice Musa in his response said that INEC has no power to disqualify any candidate and insists that the petition of the ANDP stands.

He also adds that only a court has the power to disqualify any candidate for any election and that the petition was filed within the 21 days which is the stipulated time for petitions to be filed.

Justice Musa describes the action of INEC to exclude the ANDP from the Bayelsa Governorship Election as illegal.

The lead judgment nullified the election of Governor Douye Diri.

INEC is also expected to include the ANDP in the Election.

However, the Chairman of the tribunal, Justice Muhammad Sirajo has dismissed the petition on technical grounds.

SHOPRITE DEBUNKS EXIT RUMOUR, SAYS WE ARE NOT LEAVING NIGERIA.

ShopRite Nigeria has debunked the story making the rounds that it intends to close shop in Nigeria.

The Country Director for Chastex Consult, Ini Archibong, in a telephone conversation with Vanguard, said: “Shoprite is not leaving Nigeria.

“We have only just opened to Nigerian investors which we have also been talking to just before now. We are not leaving, who leaves over a $30billion investment and close shop? It doesn’t sound right.

“We only gave this opportunity to Nigeria investors to come in and also help drive our expansion plan in Nigeria. So we are not leaving.

“I have tried to say this to many people as I can. There should be no panic at all and all of that. There is no truth in that report.”

Recall that reports have been circulating that the retail outlet has started a formal process to consider the potential sale of all or a majority of stake in its supermarkets in Nigeria.

The report said the retailer had struggled in the Nigeria market after some South African owned retailer shops exited the Nigeria market.
The report further stated that Shoprite results for the year do not reflect any of their operations in Nigeria as it will be classified as a discontinued operation.
The report also said international markets excluding Nigeria contributed 11.6 per cent to the group sales and reported 1.4 per cent decline in sales from 2018.

South African operations contributed 78 per cent of the overall sales and saw 8.7 per cent rise for the years.

The report went further to say that as a result of the lockdown, customers’ visits declined 7.4 per cent but the average basket spends increased by 18.4 per cent.

MALI SOLDIERS KILLED BY REBELS ALID HEIGHTENED POLITICAL CRISIS.

Five soldiers were killed and five others wounded in an ambush on a military convoy and an artillery attack on a camp on Sunday, both attacks blamed on rebel fighters in central Mali, army and local sources said.

The bloodshed came some six weeks after rebel fighters ambushed a military convoy, also in central Mali, killing 24 soldiers.

Fighters unleashed a revolt in northern Mali in 2012 that has since spread to the centre of the poor country and to neighbouring Burkina Faso and Niger despite the presence of thousands of French and UN troops.

The latest attacks came as President Ibrahim Boubacar Keita faces insistent calls to resign from an opposition angry over the brutal conflict as well as dire economic conditions and perceived corruption.

Much of the current tension was sparked in April when the Constitutional Court tossed out 31 results from long-delayed parliamentary elections - a move that benefitted Keita's party.

The so-called June 5 Movement (M5-RFP) has continued to insist on Keita's departure, despite two mediation missions by the regional bloc ECOWAS that has suggested a new unity government and a resolution to the election quarrel.

NDDC: ORJI KALU REPLIES AKPABIO AFTER BEING MENTIONED IN CONTRACT SCANDAL.

The chief Whip of the Senate, Senator Orji Uzor Kalu, has insisted that the Niger Delta Development Commission (NDDC) has not paid any money to the contractors who built the roads he facilitated.

Kalu was reacting to a letter written by the Minister of Niger Delta Affairs, Senator Godswill Akpabio, where he reportedly mentioned ex-Governors Emmanuel Uduaghan, James Ibori, Senator Ifeanyi Ararume, and Senator Orji Uzor Kalu, as those who benefited from the NDDC contracts.

In a statement signed by Barrister Emeka Nwala, Kalu made it clear that the issues at stake in the NDDC has nothing to do with projects carried out, but missing funds.

According to him, the road projects Akpabio listed were the interventions he facilitated for the communities as a private citizen even before he became a lawmaker.

Kalu claimed his name was included, because he used his letter headed paper to write to the NDDC in 2016, pleading with the agency to repair roads in Abia.

“Between 2016 and 2018, during my tour to several communities, leaders and welfare unions pleaded for urgent intervention on some dilapidated roads. I wrote to the NDDC informing the body of the conditions of these roads and the need for their attention since Abia is an NDDC state.

“The NDDC in their consideration which I am very grateful to, awarded the roads to companies that duly tendered for the projects and not myself. Whatever link I have with the projects is because it was considered due to my intervention,” part of the statement read.

Kalu added that, “The contractors have completed and delivered these roads a long time ago, except Abam-Atani road which I learnt from the contractors was slowed down due to rain, but still ongoing.”

BUHARI RECEIVES CORRUPTION ALLEGATIONS AGAINST MALAMI.

Anti-corruption groups in Nigeria have submitted corruption allegations against the Attorney General of the Federation and Minister of Justice, Abubakar Malami to President Muhammadu Buhari.

Their letter was titled “Compilation of Corruption Allegations and Abuse of Office”.

It was signed by the Chairman, Civil Society Network Against Corruption, Olanrewaju Suraju; Chairman, Centre for Anti-Corruption and Open Leadership, Debo Adeniran; and Co-founder, Say No Campaign, Ezenwa Nwagwu.

The coalition called for the immediate probe of Malami to ensure a full inquiry devoid of interference.

It insisted that there are very strong allegations Malami with clear evidence and urged Buhari to act immediately.

“We have listed these corruption cases after painstaking compilation of high profile corruption cases involving the country’s No 1 law officer. The President must act without delay,” the groups said.

They told Buhari that his action has the prospect of determining the future of the anti-corruption campaign in the country.

The allegations include the alleged auctioning of sea vessels holding crude oil seized by the Federal Government, violating Section 31(2) and (4) of the EFCC Act 2004.

The coalition said Malami also authorized the sale of vessels by companies under EFCC prosecution for similar offence of illegal bunkering.

“This action was admitted by the AGF through his media aide pleading presumption of innocence on the part of the accused, in the case being prosecuted by the Federal Government through EFCC,” the letter read.

The minister was accused of twisting the law to shield his family members, corrupt officials and institutions in the most brazen manners.

The AGF was blamed for the reinstatement of Abdulrasheed Maina, former Chairman of the Pension Reform Task Team, into the Federal Civil Service Commission without due process.

Malami was accused of filing for the discontinuation of a N25billion criminal charge against Senator Danjuma Goje without any justification after over seven years of diligent investigation and prosecution by the Economic and Financial Crimes Commission (EFCC).

He was alleged to have withdrawn criminal charges against soldiers accused of killing police officers and a civilian in the bid to aid the escape of billionaire kidnapper, Bala Hamisu, popularly known as Wadume.

The letter recalled that on November 18, 2018, Malami, through a lawyer from his office, Pius Akuta, withdrew a fraud case filed by the EFCC at Lagos High Court against John Abebe, younger brother to late Stella Obasanjo.

It noted that EFCC resisted the illegal move in the case before Justice Mojisola Dada on the ground that the AGF has no constitutional power to take over a case filed in the court.

The coalition cited withdrawal of a criminal case against the Chairman, Code of Conduct Tribunal (CCT), Danladi Umar; demand for the withdrawal of the cases against Mohammed Bello Adoke, Diezani Alison-Madueke and others involved in the Malabu Oil scandal; suspension of investigation of alleged fraud in Nigeria Incentive-Based Risk Sharing System for Agricultural Lending (NIRSAL).

The AGF was also accused of duplicity of payment of $16.9million fees to two friends as new lawyers for the recovery of the loot traced to a former Head of State, Sani Abacha, after a Swiss lawyer, Enrico Monfrini, who helped in the recovery was fully paid by the previous government.

The minister was indicted for halting the prosecution of former Comptroller General of Customs, Mohammed Inde Dikko, through an alleged suspicious deal between the AGF and the immediate past DSS Director General, as well as shielding the ex-Customs boss from refunding of $8million to the government.

The groups said their investigations suggest that Malami allegedly owns assets worth billions, acquired after his appointment.

Those listed were Rayhaan Hotels worth about N500million, located at opposite Aminu Kano Teaching Hospital, Zaria Road, Kano State; a property worth about N600million located at Ahmadu Bello Way, Nasarawa GRA, Kano; a newly constructed school at the back of Nitel at Gesse Phase 1, Birni Kebbi, Kebbi State, worth about N700million.

Others: A property allegedly built by Malami for his son located at Gesse Phase II in Birni Kebbi worth over N400million; a mansion known as Azbir Arena allegedly built by Malami for his second son; Azbir Arena, an entertainment centre worth over N3billion, with a big plaza and kids playing centre and hotel, all combined in one expansive property.

Malami was accused of using the official letterhead of the office of AGF to seek support for his son’s wedding and that he encouraged the defacing of Naira and other currencies to the embarrassment of the country and in violation of section 21(1) and (3) of the Central Bank Act, 2007.

He was accused of allowing the breach of COVID-19 protocol and regulations, putting the lives of Nigerians at risk during the wedding of his son.

The minister was said to have displayed “his unpretentious hatred for the fight against corruption by writing a letter dated 16th December, 2016 withdrawing the case of fraud filed against Godsday Orubebe, former Minister for Niger Delta, in a case involving over N1.97billion, on the ground that there was no basis for filing the charge against him.

The coalition said they believe in due process “which is why we have forwarded this petition to your Excellency for investigation and action in order to restore the sanity of the core mandate of your administration to fight corruption which is at the verge of collapse as a result of the alleged abuse of power and office by the incumbent Attorney General and Minster of Justice.”

SHOPRITE INITIATES PROCESS TO EXIT NIGERIA.

The Board of Africa’s biggest retailer, Shoprite Holdings Limited, has announced plans to discontinue operations in Nigeria after 15 years.

This was disclosed in the company’s operational and voluntary trading update that was published Monday morning.

The largest retail group, which announced a 6.4 per cent increase (R156.9billion) in total sales of merchandise for the outgoing year despite the challenges posed by the COVID-19 pandemic, announced that it took the decision to discontinue its Nigeria operation “following approaches from various potential investors, and in line with our re-evaluation of the group’s operating model in Nigeria.”

The Board has decided to initiate a formal process to consider the potential sale of all, or a majority stake, in Retail Supermarkets Nigeria Limited, a subsidiary of Shoprite International Limited. As such, Retail Supermarkets Nigeria Limited may be classified as a discontinued operation when Shoprite reports its results for the year. Any further updates will be provided to the market at the appropriate time,” the report stated.

While the company’s total sales of merchandise may be on the rise, it is struggling outside South Africa. According to the report, the non-South Africa supermarket operation of the company, excluding Nigeria, contributed a paltry 11.6 per cent to the group sales. Its non-South Africa sales also declined by 1.4 per cent in the year under review. The company blamed this decline on the lockdown announced in several African countries due to the coronavirus pandemic.

“Second half constant currency sales growth of 6.3% was significantly impacted by lockdown regulations across the 14 African countries in which we trade. Lockdown restrictions pertaining to store closures; social distancing; transport restrictions; the movement of people; trading hours; workforce limitations and trade in alcohol impacted various regions to differing degrees at different times.”

Shoprite came into Nigeria in December 2005 and now has a total of 26 stores across eight states in the country including Federal Capital Territory, Abuja. The company also claim to have employed more than 2,000 people in Nigeria, of which 99 per cent of them are Nigerians.
