في الوقت الذي تُجدّد فيه تونس الإعراب عن إدانتها لأي اعتداء تتعرض له الجمهورية الإسلامية الإيرانية يطال مقدّراتها وحرمتها وسيادتها الوطنية وأمن شعبها الشقيق فإنها تُعبّر عن تضامنها مع أشقائها في دولة قطر الشقيقة وتؤكّد رفضها القاطع للاعتداءات التي تعرضت لها ولأي عمل عسكري يستهدف حرمتها الترابية ويمس من سيادتها ويهدد أمن وسلامة شعبها الشقيق.
وتدعو تونس جميع الأطراف إلى إحباط ما يسعى إليه الكيان الصهيوني الغاشم لبثّ الفرقة والانقسام بين الدّول والتصدّي لمخططاته ومآربه لزعزعة أمن المنطقة واستقرارها.
كما تدعو العالم بأسره والإنسانية جمعاء إلى وضع حدّ لعربدة الكيان الصهيوني وهمجيته الذي استباح كلّ المبادئ والقيم ومازال يرتكب كلّ يوم أبشع الجرائم في حقّ الشعب الفلسطيني.

Tout en réitérant sa condamnation de toute agression contre la République Islamique d'Iran qui porte atteinte à ses ressources, à son inviolabilité, à sa souveraineté nationale et à la sécurité de son peuple frère, la Tunisie exprime sa solidarité avec ses frères de l'État frère du Qatar et souligne son rejet catégorique des attaques dont il a fait l'objet et de toute action militaire qui vise son intégrité territoriale, porte atteinte à sa souveraineté et menace la sécurité et la sûreté de son peuple frère.
La Tunisie appelle toutes les parties à contrecarrer ce que l'entité sioniste brutale cherche à semer la discorde et la division entre les pays et à faire face à ses plans et projets visant à déstabiliser la sécurité et la stabilité de la région.
La Tunisie appelle également le monde entier et l'humanité à mettre fin à l'arrogance et à la barbarie de l'entité sioniste, qui a violé tous les principes et toutes les valeurs et continue de commettre chaque jour les crimes les plus odieux contre le peuple palestinien.

While Tunisia reiterates its condemnation of any aggression against the Islamic Republic of Iran that affects its assets, inviolability, national sovereignty and the security of its brotherly people, it expresses its solidarity with its brothers in the brotherly State of Qatar and emphasizes its categorical rejection of the attacks to which it has been subjected and any military action that targets its territorial integrity, undermines its sovereignty and threatens the security and safety of its brotherly people.
Tunisia calls on all parties to thwart what the brutal Zionist entity seeks to sow discord and division among countries and to confront its plans and schemes to destabilize the security and stability of the region.
Tunisia also calls on the entire world and humanity to put an end to the Zionist entity's arrogance and barbarism, which has violated all principles and values and continues to commit the most heinous crimes against the Palestinian people every day.

إنّ تونس لا تكتفي بالتأكيد مجدّدا على إدانتها الواضحة والصّريحة للاعتداءات الصهيونية السّافرة على الجمهورية الإسلامية الإيرانية الشقيقة وما تبعها من عملية قصف لمنشآتها النووية من الولايات المتحدة الأمريكية، بل تدعو إلى إيقاف هذا العدوان فورا، فالشرعية الدولية لا تُجيزه أو تبرّره تحت أيّ غطاء أو أيّ عنوان فإمّا أن تكون هناك شرعية بالرغم من نقائصها تسري على الجميع وإمّا أنّه غياب تامّ لها بل تغييب متعمّد لمبادئها وضرب عرض الحائط لقواعدها.
كما تؤكد تونس مجدّدا على أنّ هذا العدوان الغاشم لا يجب أن يحجب عديد الجرائم الأخرى التي ارتُكبت ولا زالت مستمرة في العديد من المناطق في العالم وأوّلها حرب الإبادة المستمرة ضدّ الشعب الفلسطيني بل يتمّ توجيه الأنظار إلى هذا العدوان ويتمّ التعتيم عمدا في عدد غير قليل من القنوات الإعلامية على جرائم العدوّ الصهيوني ضدّ الشعب الفلسطيني بهدف كسر إرادته في التحرّر الكامل وهي إرادة لن تنكسر ولن تلين أبدا حتّى يستعيد الشعب الفلسطيني كلّ حقوقه المشروعة ويُقيم دولته المستقلة كاملة السيادة على كلّ أرض فلسطين وعاصمتها القدس الشريف.
كما تجدّد تونس تأكيدها على أنّ الشرعية التي أفرزتها الحرب العالمية الثانية بصدد التهاوي والمستقبل هو للشعوب الحرّة التي تضع في المقام الأول والأساسي المفاعلات الحقيقية للإنسانية المرتكزة على القيم التي تتقاسمها وعلى الحقّ الكامل في المساواة الفعلية وفي تقرير مصيرها بنفسها وتضع حدّا نهائيا للتمييز القائم على وجود دول تعتبر شعوبها ولا تزال متحضرة في حين أنّ الشعوب الأخرى هي عندها شعوب همجية ودونها مرتبة بل أكثر من ذلك مكوناتها من غير جنس البشر، هذا فضلا عن الاستعمار والحروب الأهلية والاستيلاء على خيراتها وثرواتها.

La Tunisie ne se contente pas de réaffirmer sa condamnation claire et explicite des agressions sionistes flagrantes contre la République Islamique d'Iran, pays frère, et du bombardement qui en a suivi de ses installations nucléaires par les États-Unis d'Amérique. Mais elle appelle également à un arrêt immédiat de cette agression, car la légalité internationale ne l'autorise ni ne la justifie sous quelque couverture ou prétexte que ce soit. Soit il existe une légalité, malgré ses imperfections, qui s'applique à tous, soit c'est une absence totale de légalité, voire une suppression délibérée de ses principes et un mépris flagrant de ses règles.

La Tunisie réaffirme également que cette agression brutale ne doit pas masquer les nombreux autres crimes commis et qui se poursuivent dans plusieurs régions du monde, au premier rang desquels la guerre génocidaire continue contre le peuple palestinien. Au contraire, l'attention est délibérément détournée vers cette agression, tandis que les crimes de l'ennemi sioniste contre le peuple palestinien sont sciemment occultés par un nombre non négligeable de médias, dans le but de briser sa volonté de libération totale - une volonté qui ne sera jamais brisée ni affaiblie jusqu'à ce que le peuple palestinien recouvre tous ses droits légitimes et établisse son État indépendant et pleinement souverain sur toute la terre de Palestine, avec Al-Qods Al-Sharif pour capitale.

La Tunisie réaffirme encore une fois que la légalité issue de la Seconde Guerre mondiale est en train de s'effondrer, et que l'avenir appartient aux peuples libres qui placent au premier plan les véritables réacteurs de l'humanité, fondés sur les valeurs partagées et sur le droit à une égalité réelle et complète, ainsi qu'à l'autodétermination. Ces peuples mettront fin une fois pour toutes à la discrimination fondée sur l'existence de nations considérées - et se considérant toujours - comme civilisées, tandis que d'autres peuples sont jugés barbares et inférieurs, voire non humains. Sans parler du colonialisme, des guerres civiles et de la spoliation de leurs richesses et ressources.

Tunisia does not merely reiterate its clear and explicit condemnation of the blatant Zionist aggressions against the sisterly Islamic Republic of Iran and the subsequent bombing of its nuclear facilities by the United States of America. It also calls for an immediate halt to this aggression, as international legitimacy neither permits nor justifies it under any cover or pretext. There must either be a legitimacy - however imperfect - that applies to all, or there is a complete absence of legitimacy, indeed a deliberate undermining of its principles and a flagrant disregard for its rules.

Tunisia further reaffirms that this brutal aggression must not obscure the many other crimes committed and still ongoing in various regions of the world, foremost among them the continuing genocidal war against the Palestinian people. Instead, attention is deliberately diverted to this aggression, while the Zionist enemy's crimes against the Palestinian people are willfully obscured by numerous media, aiming to break their will for complete liberation - a will that shall never be broken or weakened until the Palestinian people regain all their legitimate rights and establish their independent, fully sovereign State on all Palestinian land, with Al-Qods Al-Sharif as its capital.

Tunisia also reiterates that the legitimacy born from World War II is crumbling, and the future belongs to free peoples who prioritize the true engines of humanity, grounded in shared values and the full right to real equality and self-determination. These peoples will definitively end discrimination based on the existence of nations considered - and still considering themselves - civilized, while other peoples are deemed barbaric and inferior, even subhuman. Not to mention colonialism, civil wars, and the plundering of their wealth and resources.

تُدين تونس بشدّة تواصل تصعيد الكيان المحتلّ في وتيرة جرائم الإبادة الجماعية التي يرتكبها ضد الشعب الفلسطيني الشقيق في قطاع غزة، وتعمّده تدمير كلّ المقوّمات الأساسية لحق الإنسان الفلسطيني في الحياة، في محاولة يائسة لدفعه للتخلي عن أرضه وكسر إرادته للدفاع عن حقوقه المشروعة، في انتهاك صارخ لكافة المواثيق الدولية والقيم الإنسانية والأخلاقية.
كما تشجب تونس إقدام قوات الاحتلال الصهيوني الغاشم على توسيع عملياتها العسكرية في قطاع غزة واحتلالها لأجزاء كبيرة منه، في فصل جديد من فصول الجرائم الصهيونية المتواصلة منذ عقود وتزداد فضاعة ووحشية يوما بعد يوم، وذلك في محاولة متجددة لفرض سياسة الأمر الواقع وإفشال كل جهود وقف العدوان السافر على الشعب الفلسطيني وعرقلة وصول المساعدات الإنسانية العاجلة إلى سكان القطاع.
وفي هذا الظرف الدقيق، تُجدّد تونس دعوتها إلى ضرورة التزام المجتمع الدولي بواجبه في حماية الشعب الفلسطيني ووضع حدّ نهائي لجرائم قوات الاحتلال الصهيوني.

La Tunisie condamne fermement la poursuite de l'escalade des crimes génocidaires perpétrés par l’entité occupante contre le peuple palestinien frère dans la Bande de Gaza et la destruction ciblée de tous les éléments du droit à la vie des Palestiniens, dans une tentative désespérée de les forcer à abandonner leur terre et de briser leur volonté de défendre leurs droits légitimes, en violation flagrante de toutes les conventions internationales et de toutes les valeurs humanitaires et morales.
La Tunisie condamne également l’escalade militaire menée par les forces occupantes sionistes dans la Bande de gaza, qui s’inscrit dans une série de crimes de plus en plus brutales, dans une nouvelle tentative d'imposer une politique de fait accompli et de contrecarrer tous les efforts visant à mettre fin à l'agression flagrante contre le peuple palestinien ainsi qu’à acheminer l'aide humanitaire urgente à la population de la Bande de Gaza.
En cette période critique, la Tunisie réitère son appel à la communauté internationale pour qu'elle assume son devoir de protéger le peuple palestinien et de mettre fin aux crimes des forces d'occupation sionistes.

Tunisia strongly condemns the continued escalation of the genocide crimes committed by the occupying entity against the brotherly Palestinian people in the Gaza Strip and its intentional destruction of all the basic elements of the Palestinian human right to life, in a desperate attempt to force them to abandon their land and break their will to defend their legitimate rights, in flagrant violation of all international conventions and humanitarian and moral values.
Tunisia also denounces the brutal Zionist occupation forces for expanding their military operations in the Gaza Strip and occupying large parts of it, in a new chapter of the Zionist crimes that have been continuing for decades and growing more horrible and brutal on a daily basis, in a renewed attempt to impose a policy of fait accompli and thwart all efforts to stop the blatant aggression against the Palestinian people and obstruct the delivery of urgent humanitarian aid to the people of the Strip.

أكّد رئيس الجمهورية قيس سعيّد لدى استقباله يوم أمس الإثنين 28 أفريل 2025 بقصر قرطاج للسيد محمّد علي النفطي وزير الشؤون الخارجية والهجرة والتونسيين بالخارج على أنّ التصريحات والبيانات الصّادرة عن جهات أجنبية مرفوضة شكلا وتفصيلا وتُعدّ تدخلا سافرا في الشأن الداخلي التونسي.

وشدّد رئيس الدّولة على أنّ تونس ليست ضيعة ولا بُستانا وإذا كان البعض يُعبّر عن أسفه لاستبعاد المراقبين الدوليين فإنّ تونس يمكن أيضا أن تُوجّه مراقبين إلى هذه الجهات التي عبّرت عن قلقها وعن أرقها المزعوم وتُطالبها أيضا بتغيير تشريعاتها واستبدال إجراءاتها.
فهذه الجهات تقلق حين تُريد أن تظهر القلق ولا يصيبها الأرق حين تنظر إلى حاضرها قبل ماضيها.

بيان بمناسبة إحياء الذكرى التاسعة والأربعين ليوم الأرض

تُحيي تونس، اليوم 30 مارس 2025، الذكرى التاسعة والأربعين ليوم الأرض، التي تُخلّد كفاح الشعب الفلسطيني الأبيّ وصموده البطولي في مواجهة جرائم الاحتلال الغاشم ومخططاته الاستئصالية وتماديه في محاولات التهجير ومصادرة الأراضي وانتزاعها من أصحابها وتهويد القدس وطمس معالمها.
ويتزامن إحياء هذه الذكرى مع إمعان الكيان المحتلّ في جرائمه ضد الإنسانية وفي سياسات التنكيل والتجويع والعزل التي يرتكبها ضد المدنيّين الفلسطينيين العزل في كل من قطاع غزة ومخيمات ومدن الضفة الغربية، دون أدنى مساءلة أو محاسبة، في خرق صارخ وغير مسبوق لكلّ المبادئ الإنسانية والقانونية والأخلاقية.
وتقف تونس اليوم وقفة اجلال واكبار للصمود البطولي للشعب الفلسطيني الشقيق الذي يُواجه بمفرده غطرسة وطُغيان الكيان المحتّل ووحشيّة ترسانته العسكرية، أمام صمتٍ مريبٍ ومُخز للمجتمع الدولي، ليُسطّر ملحمة تاريخيّة جديدة في نضاله المتواصل لاسترداد أراضيه المغتصبة واستعادة حقوقه التاريخية المشروعة.
وتُجدّد تونس، بهذه المناسبة، دعمها غير المشروط للشعب الفلسطيني الشقيق في الذود والدفاع عن حقه غير القابل للتصرّف والذي لا يسقط بالتقادم، وتؤكّد على موقفها الثابت والمناصر للأشقاء الفلسطينيين في تقرير مصيرهم وفي نضالهم من أجل استعادة حقوقهم التاريخية المشروعة كاملة وإقامة دولتهم على كامل أرض فلسطين وعاصمتها القدس الشريف.

La Tunisie commémore aujourd'hui, le 30 mars 2025, le 49e anniversaire de la Journée de la Terre, qui marque la lutte du fier peuple palestinien et sa résistance héroïque face aux crimes de l'occupation brutale, à ses plans d'éradication et à ses tentatives persistantes de déplacement, de saisie et de dépossession des terres, de judaïsation de Al Qods Al Charif et de suppression de ses caractéristiques.
La commémoration de cet anniversaire coïncide avec la persistance de l'entité occupante dans ses crimes contre l'humanité et ses politiques de violence, de famine et d'isolement contre des civils palestiniens désarmés dans les camps et les villes de la Bande de Gaza et de la Cisjordanie, sans avoir à rendre de comptes, dans une violation flagrante et sans précédent de tous les principes humanitaires, juridiques et moraux.

Tunisia commemorates today, March 30, 2025, the 49th anniversary of Land Day, which marks the struggle of the proud Palestinian people and their heroic resistance in the face of the brutal occupation's crimes, its plans for eradication and its persistent attempts to displace, seize and dispossess land, Judaize Al-Quds and remove its characteristics.
The commemoration of this anniversary coincides with the occupying entity's persistence in its crimes against humanity and its policies of violence, starvation and isolation against unarmed Palestinian civilians in the camps and cities of the Gaza Strip and the West Bank, without accountability, in a flagrant and unprecedented violation of all humanitarian, legal and moral principles.
Tunisia pays tribute to the heroic determination of the brotherly Palestinian people, who face alone the arrogance and tyranny of the occupying entity and the brutality of its military arsenal, in the face of the suspicious and shameful silence of the international community, to write a new page of history in their ongoing struggle to recover their usurped lands and restore their legitimate historical rights.

تُدين تونس بأشدّ العبارات العدوان الصهيوني الهمجي الذي شنّته قوات الاحتلال، فجر اليوم، الثلاثاء 18 مارس 2025، على مناطق عدّة في غزة والذي أسفر في حصيلة غير نهائية عن استشهاد المئات من المدنيّين الأبرياء من النساء والأطفال والشيوخ وإصابة مئات آخرين إلى جانب عدد كبير من المفقودين، وذلك في انتهاك صارخ لاتفاق وقف إطلاق النار وتنكّر تام لكل قواعد القانون الدّولي الإنساني ولكلّ القيم الإنسانية، وفي سعي محموم لنسف جهود التهدئة ورغبة واضحة في تفجير الأوضاع في المنطقة.
إنّ إمعان الكيان الصهيوني الغاصب في حرب الإبادة ضدّ الشعب الفلسطيني تحت أنظار العالم كلّه دليل لا فقط على فشله في حربه لتصفية الحقّ الفلسطيني بل دليل في نفس الوقت على أنّه لم يقدر ولن يقدر بالتأكيد على القضاء على الإرادة في التحرير الكامل لأرض فلسطين. فكلّما تعدّدت المجازر إلاّ وزاد العزم والإصرار على التشبّث بالأرض ودحر قوات الاحتلال منها، فلا حرب الإبادة التي ترتكبها قوات الاحتلال ستنجح ولا الإرادة في التحرير ستفلّ أو تنكسر.
إنّ تونس لا تدعو فقط إلى فرض الشرعية الدولية بل تدعو الإنسانية كلّها إلى وضع حدّ لهذه المجازر المروّعة التي تُرتكب في حقّ شعب أصرّ وسيبقى مصرّا على تحرير أرضه كاملة وإقامة دولته المستقلة على كلّ أرض فلسطين وعاصمتها القدس الشريف.

La Tunisie condamne avec la plus grande fermeté l'agression sioniste barbare perpétrée par les forces d'occupation aujourd'hui mardi 18 mars 2025 à l'aube, sur plusieurs zones de Gaza, ce qui a abouti, dans un bilan non définitif, au martyre de centaines de civils innocents, dont des femmes, des enfants et des personnes âgées, et à la blessure de centaines d'autres, outre un grand nombre de disparus, en violation flagrante de l'accord de cessez-le-feu et au mépris total de toutes les règles du droit international humanitaire et de toutes les valeurs humanitaires, dans une tentative de saboter les efforts d’apaisement et une volonté manifeste de faire exploser la situation dans la région.
La perpétuation par l'entité sioniste de sa guerre génocidaire contre le peuple palestinien sous les yeux du monde entier constitue la preuve non seulement de son échec dans sa guerre de liquidation du droit palestinien, mais aussi la preuve qu'elle n'a pas pu, et ne pourra certainement pas, éliminer la détermination de libération totale de la terre de Palestine. Plus les massacres sont commis, plus la détermination de s'accrocher à la terre et d’évincer de celle-ci les forces d'occupation est grande. La guerre génocidaire perpétrée par les forces d'occupation n'aboutira pas et la volonté de libérer la terre ne sera pas brisée.
La Tunisie appelle non seulement à l'imposition de la légitimité internationale, mais appelle l'humanité tout entière à mettre fin à ces massacres horribles commis contre un peuple qui a insisté et continuera d'insister sur la libération de sa terre et l'établissement de son État indépendant sur toute la terre de Palestine avec Al-Quds Al-Sharif comme capitale.

Tunisia condemns with the strongest terms the barbaric Zionist aggression perpetrated by the occupation forces at dawn today, Tuesday 18 March 2025, against several areas in Gaza, which resulted, in a non-definitive toll, in the martyrdom of hundreds of innocent civilians, including women, children and elderly, and the injury of hundreds of others, in addition to a large number of missing persons, in a flagrant violation of the ceasefire agreement and a complete disregard for all rules of international humanitarian law and all humanitarian values, in a frantic attempt to undermine efforts to calm the conflict and a clear intention to escalate the situation in the region.
The Zionist entity's continuation of its genocide war against the Palestinian people in full sight of the whole world is proof not only of its failure in its war to eradicate the Palestinian right, but also an evidence that it has not been able and certainly will not be able to eliminate the determination to fully liberate the land of Palestine. The more massacres are committed, the more determined and persistent the occupation forces are to cling to the land and push the occupation forces out of it, as the genocide war committed by the occupation forces will not succeed and the determination to liberate will not be broken.
Tunisia not only calls for the imposition of international legitimacy, but also calls on all humanity to put an end to these horrific massacres committed against people who have persisted and will continue to persist in liberating their land and establishing their independent State on all the land of Palestine, with Al-Quds Al-Sharif as its capital.

وتطرّق الوزير، خلال اللّقاء، إلى حصيلة برنامج العودة الطّوعيّة خلال سنة 2024 والثلاثي الأوّل من سنة 2025، مشدّدًا على أهميّة تظافر الجهود ومواصلة التّنسيق بين جميع الأطراف المتدخّلة، بما يُساهم في نجاح البرنامج في جميع مراحله.
ودعا الوزير إلى تكثيف الحملات التّوعويّة في صفوف المهاجرين غير النّظاميّين للتّعريف ببرنامج العودة الطّوعيّة وبما يُوفّره من إمكانيّات لإعادة إدماجهم في بلدانهم الأصليّة، والتي تقوم بها بعثة المنظّمة الدّوليّة للهجرة بانتظام حسب إفادة رئيسها الذي أثنى على التّنسيق المحكم القائم مع الجهات التّونسيّة المختصّة.
وذكّر الوزير، في هذا السّياق، بموقف تونس الرّافض لأن تكون دولة عبور أو توطين للمهاجرين غير النّظاميّين، وبحرصها على أن تتمّ العودة إلى بلدان الأصل بصفة طوعيّة وآمنة على نحوٍ يحفظ الكرامة البشريّة ويتوافق مع التزاماتها الدّوليّة ذات الصّلة.

Dans le cadre du suivi de la mise en œuvre des programmes de coopération avec l'Organisation Internationale pour les Migrations (OIM), notamment en matière de retour volontaire des migrants en situation irrégulière, M. Mohamed Ali Nafti, Ministre des Affaires Etrangères, de la Migration et des Tunisiens à l'Etranger, a reçu aujourd'hui, mercredi 12 mars 2025, M. Azzouz Samri, Chef de Mission de l'OIM en Tunisie.
Le Ministre a évoqué, lors de la réunion, le bilan de la mise en œuvre du programme de retour volontaire au cours de l'année 2024 et du premier trimestre de l’année 2025, soulignant l’importance de la conjugaison des efforts et de la poursuite de la coordination entre toutes les parties prenantes, à même de contribuer à la réussite du programme dans toutes ses phases.
Le Ministre a appelé à intensifier les campagnes de sensibilisation menées auprès des migrants en situation irrégulière pour faire connaitre le programme de retour volontaire ainsi que les possibilités de réinsertion dans leur pays d’origine. Campagnes que la Mission de l’OIM mène régulièrement, selon le Chef de la Mission, qui s’est félicité de la coordination étroite établie avec les autorités tunisiennes compétentes.
Le Ministre a rappelé, dans ce contexte, la position de la Tunisie qui refuse d'être un pays de transit ou d’installation pour les migrants en situation irrégulière, et son attachement à garantir un retour volontaire sur et digne vers les pays d'origine dans le respect de la dignité humaine et conformément à ses obligations internationales pertinentes.

As part of the follow-up of the implementation of cooperation programs with the International Organization for Migration (IOM), notably concerning the voluntary return of irregular migrants, Mr. Mohamed Ali Nafti, Minister of Foreign Affairs, Migration and Tunisians Abroad, received today, Wednesday March 12, 2025, Mr. Azzouz Samri, IOM Head of Mission in Tunisia.
During the meeting, the Minister reviewed the implementation of the voluntary return program over the course of 2024 and the first quarter of 2025, underlying the importance of combining efforts and pursuing coordination between all stakeholders, in order to contribute to the success of the program in all its phases.
The Minister called for an intensification of awareness-raising campaigns aimed at irregular migrants, to inform them of the voluntary return program and the possibilities for reintegration in their country of origin. According to the Head of the IOM Mission, these campaigns are carried out on a regular basis, and he welcomed the close coordination established with the relevant Tunisian authorities.
The Minister recalled, in this context, Tunisia's position in refusing to be a country of transit or settlement for irregular migrants, and its commitment to guaranteeing a safe and dignified voluntary return to the countries of origin, with respect for human dignity and in compliance with its relevant international obligations.

تلقّت تونس ببالغ الاستغراب ما جاء في البيان الصادر عن المفوّض السامي لحقوق الانسان من مغالطات وانتقادات بخصوص وضعيات بعض الأشخاص من المواطنين التونسيين الذين يخضعون لتتّبعات عدلية من القضاء الوطني.

إنّ تونس ليست في حاجة إلى تأكيد حرصها على حماية حقوق الإنسان إيمانا عميقا منها بهذه الحقوق فضلا عن التزامها بما نصّ عليه دستورها وبما أقرّته قوانينها الوطنية وما التزمت به على الصعيد الدّولي في المستويين الإقليمي والعالمي.

وكان يمكن للدولة التونسية أن تُندّد بممارسات تضعها في خانة اعتداءات صارخة على حقوق الإنسان، ولكنّها نأت بنفسها عن ذلك لرفضها التدخل في شؤون الغير بل إنّ تونس يمكن في هذا الإطار أن تُعطي دروسا لمن يعتقد أنّه في موقع يُتيح توجيه بيانات أو دروس.

ولعلّه من المفيد التذكير بأنّ قوات الأمن التونسي تتولّى حين تُنظّم مظاهرات لا ملاحقة المتظاهرين بل تقوم بتأمينهم وحمايتهم وتُوفّر لعدد من الأشخاص المعارضين حماية خاصة حتّى لا يتعرّضوا لأيّ اعتداء.
أمّا أولئك الذين تمت إحالتهم على القضاء، فذلك بتقدير مستقلّ من القضاة، ولا دخل لأيّ جهة غير قضائية في ما يتّخذه القضاة من إجراءات في إطار تطبيق القانون الذي يفرض توفير كلّ الضمانات القضائية من معاملة لا تمسّ بالكرامة الإنسانية ومن حقّ الدفاع وغيرها من الضمانات.

وتؤكّد تونس، في هذا السياق، أنّ إحالة المتّهمين موضوع البيان تمّت من أجل جرائم حقّ عامّ لا علاقة لها بنشاطهم الحزبي والسياسي أو الإعلامي أو بممارسة حريّة الرأي والتعبير. فليس لأحد أن يتذرّع بكونه فوق المحاسبة أو يستعمل وسائل ضغط في الدّاخل أو في الخارج للتفصّي من العدالة أو الإفلات من العقاب.

وتتساءل تونس كيف كان سيتصرّف القضاء حين يُصرّح أحد أنّه سيشعل حربا أهلية ورتّب بالفعل لإشعالها، وماذا كان سيفعل حين يقول آخر أنّه أعدّ مائة ألف انتحاريّا وهم مستعدّون للقيام بعمليات إرهابية، وماذا كانت السلطات القضائية في أيّ دولة من دول العالم ستفعل حين يُذبح جنودها وتُقطع رؤوس الأبرياء وتُزرع الحقول بالألغام وغيرها من الأفعال التي تُجرّمها قوانين كلّ الدول فضلا عن تجريمها في عدد من المعاهدات الدولية المتعلقة بمكافحة الإرهاب وغسيل الأموال والجرائم السيبرنية وغيرها.
ثمّ هل إنّ القذف والثّلب وهتك الأعراض أفعال تدخل في خانة حرية الرأي؟ وهل في بثّ الإشاعات وتأجيج الأوضاع فضلا عن التخابر مع جهات أجنبية أفعال لا يُجرّمها القانون كما هو سائد في كلّ دول العالم؟

لعلّ التهم الموجهة لتونس اليوم هو أنّ شعبها أراد أن يعيش حرّا في وطن كامل الاستقلال والسيادة، ولو طأطأ رأسه، ولن يفعل أبدا، لتهاطلت عليه من هذه الجهات التي تُعرب عن قلقها شهادات في حسن السيرة والسلوك.

La Tunisie a reçu avec une profonde stupéfaction les inexactitudes et critiques contenues dans le communiqué publié par le Haut-Commissariat des Nations Unies aux Droits de l'Homme (HCDH), concernant la situation de certains citoyens tunisiens faisant l'objet de poursuites judiciaires par la justice nationale.
La Tunisie n’a pas besoin de souligner son attachement à la protection des droits de l'Homme, car elle croit fermement en ces droits et respecte les dispositions de sa Constitution, de ses lois nationales et de ses engagements internationaux aux niveaux régional et international.

L’État tunisien aurait pu condamner des pratiques qui seraient considérées comme des violations flagrantes des droits de l'Homme, mais il s’en est abstenu car il refuse de s’ingérer dans les affaires des autres. Dans ce contexte, la Tunisie pourrait donner des leçons à ceux qui pensent être en position de faire des déclarations ou donner des leçons. Il est peut-être utile de rappeler que lorsque des manifestations sont organisées, les forces de sécurité tunisiennes ne poursuivent pas les manifestants, mais les sécurisent et les protègent, et fournissent même une protection spéciale à plusieurs figures de l’opposition pour qu’elles ne soient exposées à aucune attaque.

Quant à ceux qui ont été déférés devant la justice, cela relève de la discrétion indépendante des juges, et aucun organe non judiciaire n’intervient dans les mesures prises par les juges dans le cadre de l’application de la loi, qui exige la garantie de toutes les protections judiciaires, y compris un traitement qui ne porte pas atteinte à la dignité humaine, le droit à la défense et d’autres garanties.

Dans ce contexte, la Tunisie affirme que le renvoi des accusés mentionnés dans la déclaration a été effectué pour des crimes de droit public qui n’ont aucun lien avec leur activité partisane, politique ou médiatique, ou avec l’exercice de la liberté d’opinion et d’expression. Nul ne peut prétendre être au-dessus de toute responsabilité ou utiliser des pressions, à l’intérieur ou à l’extérieur du pays, pour échapper à la justice ou à la sanction.

La Tunisie se demande comment le système judiciaire aurait réagi si quelqu’un avait déclaré qu’il allait déclencher une guerre civile et avait effectivement pris des dispositions pour la déclencher. Que serait-il arrivé si un autre avait affirmé avoir préparé 100 000 attaquants-su***des prêts à mener des opérations terroristes ? Que feraient les autorités judiciaires de n’importe quel pays au monde si leurs soldats étaient massacrés, des innocents décapités, des champs minés et d’autres actes criminalisés par les lois de tous les pays ainsi que par plusieurs traités internationaux sur la lutte contre le terrorisme, le blanchiment d’argent, la cybercriminalité et d’autres infractions ?

La diffamation, les calomnies et les agressions indécentes relèvent-elles de la catégorie de la liberté d’opinion ? La propagation de rumeurs, l’attisement des tensions ainsi que le fait d’entretenir des intelligences avec des parties étrangères ne sont-elles pas criminalisées par la loi, comme c’est le cas dans tous les pays du monde ?

Peut-être que les accusations portées aujourd’hui contre la Tunisie sont dues au fait que son peuple a voulu vivre librement dans un pays pleinement indépendant et souverain. Et s’il avait baissé la tête, ce qu’il ne fera jamais, il aurait été couvert de certificats de bonne conduite par ceux qui expriment aujourd’hui des inquiétudes.

Tunisia has received with deep astonishment the inaccuracies and criticisms contained in the statement issued by the United Nations High Commissioner for Human Rights (OHCHR), regarding the situations of some Tunisian citizens who are subject to judicial prosecution by the national judiciary.
Tunisia does not need to emphasise its keenness to protect human rights as it deeply believes in these rights and is committed to the provisions of its Constitution, its national laws and its international commitments at the regional and international levels.
The Tunisian state could have condemned practices that would be considered blatant violations of human rights, but it refrained from doing so because it refuses to interfere in the affairs of others, and in this context, Tunisia can give lessons to those who think they are in a position to make statements or lessons. It may be useful to recall that when demonstrations are organised, the Tunisian security forces do not pursue the demonstrators, but rather secure and protect them and provide a number of opposition figures with special protection so that they are not exposed to any attack.
As for those who have been referred to the judiciary, this is at the independent discretion of the judges, and no non-judicial body has any involvement in the measures taken by the judges in the framework of the implementation of the law, which requires the provision of all judicial guarantees, including treatment that does not undermine human dignity, the right to defence, and other guarantees.
In this context, Tunisia affirms that the referral of the defendants in the statement was made for crimes of public right that have nothing to do with their party, political or media activity or the exercise of freedom of opinion and expression. No one can claim to be above accountability or use pressure at home or abroad to evade justice or escape punishment.
Tunisia wonders how the judiciary would have acted when someone declared that he would ignite a civil war and actually arranged to ignite it, what would he have done when another said that he had prepared 100,000 su***de attackers ready to carry out terrorist operations, and what would the judicial authorities in any country in the world have done when their soldiers were slaughtered, innocent people were beheaded, fields were planted with mines and other acts that are criminalised by the laws of all countries as well as by a number of international treaties on combating terrorism, money laundering, cybercrime and others.
Are slander, defamation and indecent assaults acts that fall under the category of freedom of opinion? Is spreading rumours and inflaming the situation as well as maintaining intelligence with foreign parties not criminalised by the law, as is the case in all countries of the world?
Perhaps the charges against Tunisia today are that its people wanted to live freely in a fully independent and sovereign country, and if they had kept their heads down, which they never will, they would have been showered with certificates of good behaviour from those expressing concern.
