In the landmark case Pabai Pabai & Anor v Commonwealth of Australia, the Federal Court ruled against Uncle Pabai and Uncle Paul, who had filed a historic climate action in 2021 to compel the Australian Government to protect the Torres Strait from the devastating effects of climate change. The plaintiffs argued that rising sea levels threaten to displace their communities and sever their deep cultural and spiritual ties to the land, making them Australia’s first climate refugees. Despite their plea for emissions cuts aligned with scientific targets—74% reduction by 2030 and net zero by 2035—the court dismissed their case. The decision left the community heartbroken: Uncle Pabai expressed sorrow for his family and community, saying love had fueled their fight; Uncle Paul said he was in shock and questioned what to tell future generations; and Aunty McRose Elu voiced grief, calling out the government's lack of duty of care and mourning the burden placed on her grandchildren’s future.
