Is Written Complaint Mandatory for FIR?

🚨 Legal Awareness Post
Many citizens are told by the police that FIR cannot be registered without a written complaint.
⚠️ This is NOT legally correct.

📜 What the Law Says

Under Section 154 CrPC / 173 BNSS:
✔ FIR can be filed even through an oral complaint
✔ Police must write it down, read it back, and take the complainant’s signature
✔ FIR’s free copy must be provided by the police

⚖️ Supreme Court Judgment – Lalita Kumari vs. Govt. of UP (2014)

➡ If the information discloses a cognizable offence,
➡ Police is legally bound to register FIR immediately
➡ No written complaint is mandatory

🛡 What to Do if Police Still Refuse FIR?

📌 Send complaint to SP u/s 154(3) CrPC / 173(3) BNSS
📌 File application before Magistrate u/s 156(3) CrPC / 175 BNSS
➡ The Court can order the police to register the FIR

Here’s what studies & monitoring reports show about how much air pollution in India increases around Diwali (largely due to firecrackers). It varies by city, pollutant, and year — but spikes are large and often dangerous.

1. **PM₂.₅ increases (fine particles)**

* Delhi: ~ 82.9% higher on Diwali day vs pre‑Diwali.
* Bhopal: ~ 81.3% increase.
* Lucknow: ~ 67.6% increase.
* Kolkata: ~ 53.6%; Shillong ~ 30.5%; Vadodara ~ 26%.

2. **PM₁₀ increases (coarse particles)**

* Lucknow: ~ 114% increase.
* Bhopal: ~ 86.2%.
* Delhi: ~ 67.1%.

3. **Other pollutants & elements**

* Elemental components of PM₂.₅ (metals etc.) can increase much more (some trace elements 5‑50×) during fireworks bursts.
