The 2-1 ruling against the law's requirement that people buy insurance, rendered by the U.S. Court of Appeals for the Fifth Circuit, represents the latest legal threat to former President Barack Obama's signature domestic policy achievement since it was enacted in 2010.

The new challenge stems from the $1.5 trillion tax cut passed by Congress in 2017, which repealed the health care law's tax on people who refuse to buy insurance."

Judges directed a lower court to determine whether the Affordable Care Act can stand without a mandate to buy health insurance or a corresponding tax.

It's amazing how much time people waste worrying about what the right will _say_ in response to a given exercise of power. With regards to the possibility of withholding articles, I've seen people warn that if the articles are withheld Trump and McConnell would say... exactly what they've said. So what? The argument in favor of withholding--that the GOP Senate intends to run a sham trial because they know Trump is guilty--gets stronger the longer the GOP Senate is committed to the bogus trial demanded of them by an unstable, undisciplined POTUS and his base.

For the other side, the exercise of power is clarifying in that it exposes the bedwetters in their caucus. Nothing terrifies a certain kind of norm-loving, centrist Democrat more than the possibility that a Democrat might play hardball in defense of their ideals with the same vigor and sense of purpose that the GOP has pursued minority and oligarchic rule.

The Republican senator accused Nancy Pelosi of being afraid to send “their shoddy work product to the Senate.”
