Dear Account Owner/Operator of ,
I am the owner and founder of Haustronaut Recordings, a house and techno music label established in 2014 and operating continuously in commerce since that time. The mark “Haustronaut” (and variations thereof) has been used by me/my entity as a brand identifier for music releases, events, artist rosters, and related services. This use is well-documented across platforms including:
• Official website: haustronaut.com
• Instagram: (verified presence since 2014)
• SoundCloud, Beatport, Discogs, and other music distribution channels
• Public records associating the mark with Nathan Lee Filby / Motoe Haus as owner/co-founder
The Haustronaut mark has acquired common-law trademark rights through extensive use in interstate and international commerce in the music industry. It is recognized in connection with underground house/techno productions, artist management, and label services.
Your Instagram account (with the Ø diacritic, profile picture of an astronaut in a similar style, and name “Hausatronaut”) uses a confusingly similar mark that is nearly identical in sound, appearance, and commercial impression to my established mark. This constitutes trademark infringement under Section 43(a) of the Lanham Act (15 U.S.C. § 1125(a)), as it is likely to cause consumer confusion, deception, or mistake as to the source, affiliation, or sponsorship of your account/content with Haustronaut Recordings.
Evidence of potential confusion includes:
• Similar spelling and phonetic identity (“Hausatronaut” vs. “Haustronaut”)
• Overlapping themes (astronaut/space imagery, music-related profile)
• Your recent direct message to me accusing me of infringement (dated around 16:28–16:33 on the attached screenshot), which ironically highlights the confusion your use creates
Demand:
You are hereby demanded to immediately:
1. Cease and desist all use of the name “Hausatronaut,” “haustrønnaut,” or any confusingly similar variation (including with diacritics) in any username, display name, bio, posts, stories, or other content on Instagram or elsewhere.
2. Permanently delete or deactivate your Instagram account (or rebrand it to a distinctly different name with no similarity to “Haustronaut”).
3. Remove all content, imagery, or references that could associate your activities with Haustronaut Recordings.
4. Provide written confirmation within seven (7) days of receipt that you have complied fully with these demands.
Failure to comply within seven (7) days may result in further legal action, including but not limited to:
• Filing a formal trademark infringement complaint with Instagram/Meta
• Initiating a lawsuit for trademark infringement, unfair competition, and related claims
• Seeking injunctive relief, damages, attorney’s fees, and costs
