While Malta is eager to back the controversial 'return hubs' in the EU such as the one Italy has set up in Albania, a recent ECJ judgment seems to have slowed down these plans. The problem lies with the designation of safe countries - is the country an asylum seeker is coming from considered to be safe or not by the receiving state?

The ECJ has clearly stated that a Member State cannot partially designate a third country as safe. It is either totally safe or it is not. You cannot have an exception with particular regions of that country. Italian Magistrates have clashed with the government over the safe country designation of Egypt and Bangladesh.
