Lawyer: Could you tell the honourable court what transpired between you and the Claimant on the 25th day of March?

Defendant: My lord, I met the Defendant on the said date as a passenger in my bus.

Lawyer: So what happened next?

Defendant: My lord, in fact we had misunderstanding over the rate of transport fare.

Lawyer: Go ahead and tell the court what further happened.

Defendant: My Lord, when the bus got fully loaded I announced to all the passengers that their transport fare from Enugu to Porthacourt was 10000 naira. Then the Claimant who was one of my passengers interjected, insisting that he had already agreed with the bus loader at the rate of 7000 naira.

Lawyer: Very well. So what happened next?

Defendant: In the course of the argument, I ordered him to go down from my bus if he was not ready to pay the amount I announced, and he went down.

Lawyer: Alright, I put it to you that you refused to pay the bus loader his commission simply because of his 700 naira bargain with the passengers.

Defendant: My lord, that's not correct. I paid the bus loader his commission before he left.

Lawyer: Even after knowing that he bargained less than the actual transport fare with passengers?

Defendant: My lord, that's their strategy of getting passengers, and it's not my business, my lord. After all, I didn't authorize him to bargain the fare.

Lawyer: With utmost respect, my lord, no further questions.

Judge: My judgement at the comment section.

LAWYER: From your testimony before this court, you were, just last week, discharged by a court in Enugu State over a charge bordering on adultēry with one Mrs Ede who is legally married to one Chief Ede?

DEFENDANT: Yes, that's correct!

LAWYER: Fine. And just a week after, you're again being arraigned over similar act with same woman, knowing fully well that she is still legally married, please tell this honourable court what led you to the act again.

DEFENDANT: My sister, sorry, my lord, I was not just discharged by the Enugu Court, but also was acquitted with the court making a pronouncement that adūltery is not a çrime.

My lord, it's in celebration of my acquittal that my lover and I came for a holiday in Kaduna where the present act took place.

LAWYER: That's ok. Now, your contention before this court, however, is that you're by law protected from another trial on same material fact, and again, that it's the pronouncement of a court of comptetent jurisdiction that adūltery is not a çrime. Is that correct?

DEFENDANT: Exactly, my lord.

LAWYER: Very well. (turning to the judge) I'm grateful, your lordship. No further questions, I rest my case.

Judge: My Judgement at the comment section.

Lawyer: You admitted before this honorable court that sometime around September, 2025, you, with the assistance of some police officers, stopped the Claimant and dispossessed him of his commercial bus. Is that correct?

Defendant: Yes, that's correct.

Lawyer: You told this court that the Claimant had bought the bus from you at the rate of 3.4 million, but had only paid 1.7 million naira, with promise to complete the payment 2 months later?

Defendant: That's correct, my lord.

Lawyer: From the records, you also confirmed before this honorable court that it was your agreement with the Claimant that the bus be in his possession pending the completion of payment. Is that correct?

Defendant: Yes, my lord. He said that putting the vehicle into commercial use will quicken his completion of the payment.

Lawyer: Very well! And again, it was your contention that since the Claimant had failed in his own part of the agreement that you had the right to repossess the bus pending when he is ready to complete the payment. Is that correct?

Defendant: Yes, Sir.

Lawyer: (Turning to the judge) No further questions, your lordship.

Judge: My judgement at the comment section
