In the Philippines, the Children's Safety on Motorcycles Act (RA 10666) prohibits driving a motorcycle with a child on board in areas with heavy vehicle traffic, high-density fast-moving vehicles, or a speed limit over \(60\) kph, with exceptions for medical emergencies. The law also states that only one passenger is allowed per motorcycle, who must be able to reach the footrests and wrap their arms around the driver, and both must wear certified helmets.
General rules for pillion riding
One passenger only: A motorcycle can only carry one passenger besides the driver.
Secure seating: The passenger must be able to hold on to the driver and have their feet on the footrests.
Headgear: Both the rider and the passenger must wear standard, DTI or BPS-certified helmets.
Passenger conditions: The passenger must have their feet on the footrests, sit behind the rider, and face forward.
Cargo: No cargo is allowed other than what is specifically designed and approved for the motorcycle.
Specific restrictions on children
Forbidden in certain areas: It is illegal to drive with a child on board on public roads with heavy traffic, high-density fast-moving vehicles, or a speed limit over \(60\) kph.
Medical exceptions: The restriction does not apply if the child needs immediate medical attention.
Safety concerns: The law is intended to increase safety for children, as they are at a higher risk of being involved in motorcycle accidents.
Penalties for violations
Fines: Violators can be fined PHP \(3,000\) for a first offense, PHP \(5,000\) for a second offense, and PHP \(10,000\) for a third offense, which also includes a one-month license suspension.
License revocation: After the third offense, the driver's license will be permanently revoked.
