Is ending birthright citizenship against the 14th amendment? Many would say yes. But, let’s look at it a little closer.
The 14th amendment was established to ensure the children of slaves brought here against their will were considered US citizens.
The amendment states: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
The key part here pertaining to Illegal immigrant’s children is they are not under jurisdiction of the United States. The slaves were considered under the jurisdiction because they were brought here unwillingly. Wording is crucial when looking at amendments and they should not be paraphrased.
It clearly states Born in the US AND under jurisdiction thereof.
