Let’s talk about the States removing President Trump from the ballot for being an insurrectionist.
The courts are citing Section 3 of the 14th Amendment which they say gives them the authority to make the decision. Here is what it says.
Section 3 Disqualification from Holding Office
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.
However, if you keep reading the 14th Amendment you will find section 5 which says this.
Section 5.
The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.
Section 5 cannot be divorced from Section 3.
This clearly states that Congress is the only body that could enforce Section 3, by appropriate legislation, which they did by passing 18 USC 2383 which states the following:
2383. Rebellion or insurrection
Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.
So to make this clear. The President can’t be removed from the Ballot or barred from office unless he is charged under this statute and found guilty and punished by Congress. Any other decision by any judge is false and unconstitutional. To put it simply what if they were trying to remove someone from office for being a murderer? The court can’t decide they are a murderer without them being charged and convicted of murder. Being charged and convicted of robbery still does not make you a murderer.
