BREAKING NEWS: Democratic Alliance Takes Expropriation Act to Court

In a significant development, the Democratic Alliance (DA) has filed papers in the Western Cape High Court, challenging the constitutionality of the Expropriation Act. The party alleges that the Act is unconstitutional, both substantively and procedurally, and that it contains vague and contradictory clauses.¹

According to the DA, the Expropriation Act grants the government sweeping powers to expropriate property without compensation, which they believe is a violation of South Africans' property rights. The party's federal council chairperson, Helen Zille, emphasized that the DA will fight to protect the property rights of all South Africans.

The DA's court challenge comes after President Cyril Ramaphosa signed the Expropriation Act into law in December 2024, despite concerns raised by the Minister of Public Works and Infrastructure, Dean Macpherson, that the Act was unconstitutional.
