A scathing disciplinary report has found Mercy Phetla, Chief Financial Officer of Matlosana Local Municipality, guilty on all five charges of gross misconduct, dishonesty and dereliction of duty.

The report, finalised in December 2025, recommends her dismissal and states her actions were not negligent but calculated and intentional, aimed at defrauding the municipality.

What she was found guilty of:
Authorising a R2.9 million payment to Variegated (Pty) Ltd for electrical material, without approval, in breach of the MFMA
- Exceeding her authority, approving payments only the municipal manager may authorise
- Wasteful expenditure of R528,000 for goods that were never delivered
- Accepting a R1.4 million VW Amarok from a municipal service provider, classified as unlawful gratification
- Bringing the municipality into disrepute following her arrest and corruption charges

The chairperson described her defence as weak and said she failed to challenge the evidence, adding she is “unrepentant” and “cannot be left anywhere near the municipality’s purse.”

The report goes further, calling it a “travesty of justice” if criminal charges and civil recovery are not pursued against Phetla and implicated service providers.

One of the most damning admissions on record: her R35,000 bail was paid by the son of the contractor accused of gifting her the luxury vehicle.

This unfolds while Matlosana remains under administration, sitting with over R11 billion in unauthorised, irregular and wasteful expenditure.

Despite the findings, opposition parties fear the ANC-led council may still try to shield her, even though the law requires the sanction to be implemented.

Council is expected to consider the report tomorrow (Thursday 21/01/2026).
