shebe maburna case hits the pre-trial stage

Lekompo musician Lehlogonolo Katlego Chauke, popularly known as Shebe Maburna, is expected back in the Polokwane Magistrates’ Court today as pre-trial proceedings in his case get underway.

The development comes a day after Chauke withdrew his third bail application, which was based on new facts.

The application was withdrawn on Wednesday after Chauke appointed new legal representatives, who requested more time to familiarise themselves with the case.

The musician faces 21 charges, including four counts of attempted murder, theft and malicious damage to property.

He has been in custody since November 2025.

His previous two bail applications, as well as subsequent appeals, were dismissed by the Polokwane Magistrates’ and High Courts.

The latest developments now see the case moving into the pre-trial phase, bringing Chauke closer to the start of the trial process.

bail denied | court raises witness interference concerns in gagash case

The wait is over. Peter “Gagash” Nonyane and attorney Charlotte Tibana have been denied bail after the magistrate raised concerns about the possibility of interference with State witnesses.

One of the factors considered was that Tibana’s appointment as executor of the estate has not yet been revoked.

The magistrate said this was relevant when considering the potential for interference with witnesses and aspects of the ongoing investigation.

The court also stressed that a bail application is not a trial and that the State is not required at this stage to close every possible loophole in its case.

The magistrate further emphasised that the burden is on the applicants to satisfy the court that the interests of justice allow them to be released.

🔴 Bail denied.

The matter is set to return to court on 6 November.

Breaking: 🔥 will gagash walk free? bail judgment set for tomorrow

Peter “Gagash” Nonyane and attorney Charlotte Tibana will have to wait another day to learn whether they will walk out of custody on bail.

After hearing final arguments from both the State and the defence, the magistrate has postponed the decision, with bail judgment set for tomorrow at 12h00 at the Polokwane Magistrate’s Court.

The big question now: Will Gagash and Tibana be granted bail, or will they remain behind bars?

“you can’t deny him bail because of his personality” — gagash’s lawyer

Advocate Maluleke has accused the State of appearing to have a motive against Peter “Gagash” Nonyane and his wife, attorney Charlotte Tibana, during closing arguments in their bail application at the Polokwane Magistrate’s Court.

Maluleke questioned why the State did not oppose bail in Johannesburg in connection with the Tembisa Hospital matter involving Stefan Joel Govindraju, arguing that the prosecution should have opposed their release.

The defence also pushed back against the State’s reliance on Gagash’s public persona and nicknames, including “La-masweet” and “Greater Gagash Municipality”.

Maluleke argued that the applicants should not lose their freedom because of their personalities, public image or the names they use on social media.

The defence is asking the court to grant bail to both Nonyane and Tibana.

“call the hawks on me” — now the hawks witness is in the hot seat 👀

The defence has challenged Hawks investigating officer Constable Khutšišo Thobejane over claims that Peter “Gagash” Nonyane and Charlotte Tibana could interfere with documentary evidence if released on bail.

During cross-examination, the defence questioned how the accused could tamper with records that are already held by independent institutions, including bank records and files at the Master’s Office.

The defence also pointed out that Thobejane had previously conceded that the applicants would not be able to interfere with such records — and questioned what had changed after new charges were added.
