Understanding Performance Royalties and the Real Issues at SAMRO

As members of SAMRO, it is important for us to have an honest and informed conversation about royalties and how they work. Many misunderstandings exist, and these misunderstandings often lead to unnecessary noise, confusion, and misplaced anger within the music industry.

Let’s be clear: performance royalties are only generated when your music is actually performed in public spaces. This includes airplay on radio and television, live performances, or when your music is played in public venues such as clubs, restaurants, malls, or events. If your music does not receive this kind of exposure, there are no royalties to collect at Samro. It’s that simple.

Unfortunately, some of our fellow members release songs that never make it to radio, television, or any public broadcast platform, and yet they expect SAMRO to pay them significant royalties , some Samro members send poor quality songs to radio and they end up not getting airplay, some Samro members get their music played at community radio stations and expect royalties from Samro so if your music is playing on community radio stations you must know that there's no royalties for you at Samro because Community radio stations don't have a blanket licence with Samro and sending your music to SABC radio stations doesn't mean you have royalties at Samro it's only when those radio stations playlist your music then you'll earn royalties at Samro.. When this does not happen, they rush to social media or the press to complain—sometimes even boasting that SAMRO only paid them less than R20. The truth is, if your music is not actively generating performance activity, your royalty statements will reflect that reality.

I cannot entertain this type of attitude because it distracts us from the serious issues that truly matter at SAMRO. We are dealing with questions of accountability, transparency, and the whereabouts of millions of rands in royalties that rightfully belong to members whose music has been performing well across platforms. That is where our focus should be—not on defending claims by individuals whose music is not in rotation but who want to paint SAMRO as a thief of their “millions.”

My message to all SAMRO members is this: check your royalty statements carefully. If you know that your music is not playing on radio, TV, or any licensed public space, then understand that your royalties will reflect accordingly. But if your music is active and generating airplay, then you should rightfully expect those earnings, and we as members must collectively demand transparency and accountability from SAMRO in how those royalties are tracked, distributed, and safeguarded.

We need to focus on the bigger picture—the governance of SAMRO, the distribution of millions of rands, and ensuring that active musicians are protected and paid fairly. Let’s stop misdirecting the fight. If we want to solve the problems at SAMRO, we must be united, informed, and focused on what truly matters................

In today’s digital music landscape, performance royalties remain one of the most important streams of income for artists, composers, and publishers. Many independent artists and record labels often ask the same questions: How do performance royalties work in the digital space? Who gets paid, and how are these royalties distributed? Let’s break it down in simple terms.

What Are Performance Royalties?

Performance royalties are payments made whenever a piece of music is publicly performed, broadcast, or streamed. Traditionally, this included radio airplay, TV, live concerts, and background music in public places. But in the digital age, “performance” also includes streams on platforms like Spotify, Apple Music, Deezer, YouTube, and even social media platforms like Facebook, Instagram, and TikTok.

These royalties are collected and distributed by Performance Rights Organizations (PROs) such as SAMRO (South Africa), ASCAP, BMI (USA), PRS (UK), and others.

1. Songwriters & Composers

They receive royalties because they are the original creators of the music.

For example, if you wrote the lyrics or composed the beat, you’re entitled to performance royalties every time the song is streamed or performed.

The vocalist or band who performed the song does not automatically receive performance royalties unless they are also the songwriter or composer.

Their earnings usually come from neighboring rights, sales, and streaming revenue—but not directly from performance royalties unless they own part of the composition.

4. Independent Record Labels

A record label does not collect performance royalties unless it owns publishing rights or shares in the composition.

Labels typically earn from sales, streaming master royalties, licensing deals, and distribution, but if they also own publishing divisions, they can claim part of the performance royalties.

Independent artists who wrote their own songs get both the writer’s and publisher’s share if they also own their publishing.

Let’s say your song reaches 1,000,000 streams on Spotify:

Spotify pays out around $3,500 – $4,500 in total royalties per million streams (this is split between master rights and publishing rights).

Of this, about 10–15% goes to publishing royalties (the pool where performance royalties come from).

That means roughly $400 – $600 is set aside for publishing.

Now here’s how it breaks down:

Writer’s Share: 50% → about $200 – $300

Publisher’s Share: 50% → about $200 – $300

👉 If you are an independent artist who also self-publishes, you collect both shares, meaning you take home the full $400 – $600 in performance royalties (plus the master royalties from your distributor).

👉 If you are signed to a record label with a publishing deal, the publisher takes their share, and you only receive the writer’s share unless your contract states otherwise.

👉 If you are only the performer (not the songwriter), you won’t see performance royalties—you’ll earn only from master royalties (paid by your distributor).
