St Tropez Body Corporate loses Supreme Court of Appeal(SCA) case against an owner of multiple St Tropez units, in the heart of Sandton.
In their arguments, the Chairman(Anton Swanepoel) and trustees of the body corporate opposed a ruling of the Judicial Conduct Committee(JCC), Office of the Chief Justice (OCJ) that ruled against Judge Mokose.
The SCA stated in a media statement, the judicial process must maintain public confidence, and upholding the JCC's findings advanced this objective. The SCA questioned why St Tropez body corporate opposed the ruling, when the judge herself had not opposed the ruling.
This marks the first case of a Body Corporate opposing a JCC(OCJ) ruling at the Supreme Court of Appeal.
Historically, the owner alleges the Body Corporate and the managing agent over the past decade failed to maintain the complex. Special levies of approximately R500000 was raised to paint the complex, but no work was carried out for 2 years, until the owners convened a special AGM. Due to the complex deteriorated state, owners were forced to either sell their properties at almost half market value or withhold levies.

The body corporate trustees are Sameer Mohamed, Robin Kieron Richardson and Mr Mokgothu.
