A 14-year-old boy has lost a court case he brought against his own parents after they moved him from London to Ghana to go to boarding school.

The boy, described in court as shy, articulate, a keen cook and footballer, said his parents had tricked him into going to Africa, saying it was to visit a sick relative.

He said had he known he was being sent to boarding school "there would have been no way I would have agreed to it".

But the High Court in London also heard his parents were worried he was being "groomed" into criminal activity.

In a written statement to the court, he said: "I feel like I am living in hell. I really do not think I deserve this and I want to come home, back to England, as soon as possible."

In his judgment, High Court judge Mr Justice Hayden said he recognised that "this is, in many ways, both a sobering and rather depressing conclusion."

He said that he was satisfied that the parents' wish for their son to move to Ghana was "driven by their deep, obvious and unconditional love".

The boy was at risk of suffering greater harm returning to the UK, he said.

He said that the boy's parents believe "and in my judgement with reason" that their son has "at very least peripheral involvement with gang culture and has exhibited an unhealthy interest in knives".

The boy's father told the judge the couple did not want their son to be "yet another black teenager stabbed to death in the streets of London."

The boy, who had lived in the UK since birth, said he was "mocked" and "never settled in" at the school in Ghana.

He said he "could also barely understand what was going on and I would get into fights".

The boy wrote that he was "so scared and desperate" that he emailed the British High Commission in Accra as well as contacting the charity Children and Family Across Borders, who it is believed put him in touch with lawyers at the International Family Law Group.

"I am from London, England, and I want to go back home," he wrote.

He said he had been "mistreated" at the school, adding: "I'm begging to go back to my old school."

However the High Court heard that the boy's parents had sent him because they feared for his safety in London.

In a statement, his mother said sending him to Africa was "not a punishment but a measure to protect him".

She referred to the murder of Kelyan Bokassa, the 14-year-old boy who was stabbed to death on a bus in Woolwich in January. That was "every parent's worst nightmare", she said.

She said she did not believe her son would survive in the UK and did not want to be part of her son's "destruction".

Rebecca Foulkes, representing the boy's father, said the boy met 11 of the points on a checklist produced by the children's charity NSPCC to indicate whether a child might have joined a gang or was being criminally exploited.

That included being absent from school, having unexplained money, buying new things, and carrying weapons.

She said it was not only the parents who were worried.

His school claimed it had "suspicions about him engaging in criminal activities" and had observed him in expensive clothes and with mobile phones.

The boy said he had never been part of a gang, nor "involved in gangs in any way". He said he "does not know anyone involved in a gang" and he does not carry a knife.

He acknowledged in his statements that "my behaviour wasn't the best" and said he thought that was the reason his parents sent him to Africa.

The case centred on the question of parental responsibility, and whether the parents acted unlawfully by sending their son to boarding school without his consent.

In a statement issued after the judgement, his parents said: "This has been a really difficult time for us all."

They added: "Our priority has always been protecting our son and our focus now is on moving forward as a family."

James Netto from the International Family Law Group, who represented the boy, said the court judgment had been a "real shock" to the teenager.

"He was obviously incredibly disappointed, incredibly upset and is considering his next steps carefully."

'I want to have an education'
The boy's barrister, Deirdre Fottrell KC, pointed out the school was not simply far from home - but a completely different jurisdiction.

The boy wrote that his education was suffering. He felt the Ghanaian classes were not as challenging as those in his English school, and he had been out of formal education entirely since last summer, studying online.

He wrote: "I want to have an education again and grow up like a normal person. I feel like my brain is hurt here. I feel like now I am dumber than people I used to be smarter than."

The boy's father has recently visited him in Africa, and he told the court that he and his son had got on well.

He said he would like his son to remain in Ghana, and said they visited a different boarding school where the boy could be considered for a place.

The father said they were both very impressed.

However, questioned by Ms Fottrell, he acknowledged there was no place in that school until September, and that his son had not said he wanted to go there.

The boy's solicitor said he had recently seen a rise in similar cases where teenagers were trying to return to the UK.

"Teenagers are often placed in exceptionally challenging or vulnerable situations, and are now beginning to turn to the court for protection," Mr Netto said.

He said he had seen cases where "in their parents' eyes" young people were "falling in with the wrong crowd or are adopting what their parents see as unorthodox or challenging behaviours".

Following the judgment, he added: "We have already received enquiries from young people in exactly the same situation as this young man."

Don’t arrest anyone before investigating, Hichilema urges ACC

PRESIDENT Hakainde Hichilema has urged the Anti Corruption Commission (ACC) to ensure that investigations take place before arresting suspects.

Speaking during a swearing in ceremony at State House today, President Hichilema stated that doing the opposite could be damaging to the reputation of the country.

He said his dissolving of the ACC board recently was because he wanted to see change in the operations.

The President further advised that the board should also be devoid of ethnicity in its dealings.

“ACC please investigate. You can’t arrest before investigating, you are damaging the reputation of the President. When we are done with investigations then we move, if the matter is bondable, give them bail, if it’s not, take them to court. You are damaging the reputation of the country,” said the Head of State.

“Where I go to market this country, the profile of this country is very high now. You can see the flows of investments. If I had the time, I would be receiving local and international everyday.”

The President further advised the newly installed officials to do what is right even when they are alone.

“Where I come from we say walls have ears. What you do in private, it’s just a matter of time, it will be out in public and remember when you are caught, you are on your own,” said President Hichilema.

KAMANGA'S UNOPPOSED WIN NULLIFIED, FOUR JOIN FAZ PRESIDENTIAL RACE AFTER SUCCESSFUL APPEALS

Four candidates have officially joined the Football Association of Zambia (FAZ) presidential race after successfully appealing their previously invalid nominations, bringing the total number of contenders to five.

The candidates now in the race include Keith Mweemba, Francis Hafwiti, Adrian Kashala, Emmanuel Munaile, and incumbent Andrew Kamanga.

Their successful appeals have led to the nullification of Kamanga’s earlier declaration as duly elected FAZ President for the 2025-2029 term, a declaration initially made on February 17, 2025, after he was announced as the sole eligible candidate.

Meanwhile, appeals by Godfrey Chikumbi, Mumbo Lombe, and Alex Njobvu were dismissed, leaving them out of the contest.

With directives from the National Sports Council of Zambia (NSCZ), FAZ has just one day left to conduct its elections, as the current executive will not be recognized beyond February 28.

Woman narrates how John General suddenly stripped naked during 'prayers'

A WOMAN of Lusaka has narrated to the Lusaka Magistrates Court how controversial pentecostal Papa, known amongst his flock as senior prophet John General derailed a baby-seeking prayer session as he suddenly stripped butt naked and forced himself on her.

Troubled by several miscarriages, the victim had contracted the clergyman, whose government-recognised name is John Nundwe, to pray for her to conceive and finally have a baby.

However, instead of engaging God in prayer for the woman and her husband to have a baby, the clergyman is said to have cast the biblical "thou shall not commit adultery" commandment aside and took matters to his own manhood.

From the November 22, 2023 incident, the 'senior prophet' harvested for himself a charge of r**e contrary to the laws of Zambia.

Clearing a possible pathway to jail for the pastor, the victim testified that the Miracle Impact Ministries International Church owner, forced her to sleep with him so that she could give a testimony like others do.

The victim testified that Nundwe invited her to his church, and told her to buy 10 bottles of anointing oil and five bottles of anointing water for her to conceive.

She told resident magistrate, Amy Masoja that she drunk nine bottles of anointing oil and used one to mop the house but it didn't work.

The victim narrated that Nundwe visited her so that he could conduct prayers in her house but ended up having carnal Knowledge with her without her consent.

"When he came to the house, he came with another man who remained in the sitting room as i was directing the bishop to the rooms, we entered the kitchen, the passage, we entered the first bedroom, and we went to the second one, and when he entered the second one, the spare bedroom, I went in my bedroom to get a note book and a pen," she said.

She said it took her five minutes to look for a book, and when she returned to the spare bedroom she found Nundwe naked.

The victim said she was scared when she saw the bishop naked and wanted to run away.

She said he told her not to run away that he wanted to have s*x with her.

"I became confused and then he called the one who was in the sitting room, who came and pushed me inside the room as I was standing by the door, and the bishop was about 4 metres away from me, as I wanted to run away he called the person in the sitting room to bring a gun," she said.

She said Nundwe pushed her on the bed and undressed her.

"When he pushed me on top of the bed I wore a dress and a chitenge material on top. He pushed me and I lay on my back as he put my legs on the bed," she said.

She told court that Nundwe got on top of her after putting her legs in a straight position.

"I started turning and shaking so that he shouldn't sleep with me, but he managed, he removed my pant and had s*x with me. Then he said, 'you don't want to give testimony like your friends do?" she said.

"I had a pad on because I was on my periods, and as he was having s*x with me I just saw him jumped off from me. He told me that I was supposed to put on the new chitenge which he had come with and that he needed to collect the urine, he will pray for it," she said.

The victim said Nundwe jumped off the bed when he heard a voice.

"It was my husband coming, as he jumped off the bed and stood beside, I also sat on the bed. Then he called the person who was in the sitting room to bring the gun and threatened that he would kill us like they killed others,I pleaded they shouldn't kill us," she said.

She said her husband left the bedroom after Nundwe requested for a gun.

"Then I saw the bishop going out of the room speaking in a language I couldn't understand, it wasn't a Zambian language. He left the room as well, and I was left there," she said.

She said she knew Nundwe in 2022.

"I remained in the room and my husband came and asked what had happened. I explained that the bishop forced himself on me and he was very upset," she said

The victim said she could recognize his grey shorts, a blue underwear, a golf t-shirt with stripes, a cap and a pair of black half shoes which was on the floor.

She said she knew Nundwe because she really wanted a child but couldn't conceive.

"I started watching his channel, I decided to visit his church for prayers and I was told if I wanted to see the man of God one on one I need to pay K1000, and that was before he visited my house for prayers," she said.

She said she paid a K1000 and was advised to buy 10 bottles of anointing oil and five bottles of anointing water, which she bought at K100 one.

"I used to communicate with bishop on WhatsApp calls and sometimes I could text him. He could call because he wanted confirmation if I had conceived after taking anointing oil. I once texted him that I wanted a child and he texted back saying 'Bwela Tupange," which got me confused," she said.

The victim further said she narrated whatever happened to her husband who was at work at that time.

"I explained everything that transpired to my husband, we are in good terms, the family sat us down and we resolved everything," she said.

She said Nundwe wanted them to reconcile but it failed.

Trial continues on tomorrow.

Mwamba's continuous court absence irks court, surety faces jail

PF faction chairperson for information and publicity, Emmanuel Mwamba's continuous absence from court has finally struck a nerve in Lusaka magistrate, Amy Masoja who has given him an ultimatum to come back or have his surety thrown behind bars.

This in a case where the 52 year old politician of plot 136A Chandwe Musonda Road, Villa is jointly charged for disordery conduct at a police station with Jacqueline Chopa, 49, a businesswoman, Gideon Tolopa, 42, of Kamwala and Gift Kachingwe, 32, both businessmen.

Masoja gave the former ambassador's surety, Boniface Chibeka, a last warning and ordered that he must attend court proceedings On March 5, 2025 without fail as she won't stand another excuse without proper explanation.

The magistrate said this when Sate Prosecutor, Brian Siayengo informed the court that the bench warrant on Mwamba was not executed and the accused was not before cour yesterday.

At this point, the court called Chibeka to explain why the accused was not present before court.

In response, Chibeka, a surety told court that he communicated with Mwamba and he told him that he was in the United States of America (USA) and will return on March 4, 2025.

But the court warned that the surety will be locked up if he is not telling the truth

"Maybe we remand the surety that's when Mwamba will come back, if the surety will be incarcerated that's when the accused will come back."

"On this predicament, the explanation is not on merit, I send a strong warning and I will not take it lightly this time around, I will give that the surety is lying to the court. This is a last warning. I adjourn the matter to March 5, 2025," magistrate Masoja warned.

All the accused persons in this matter are charged with one count of disorderly Conduct at the Police Station Contrary to Section 60 (1) of the The Zambia Police Act Chapter 107 of the Laws of Zambia.

It is alleged that Mwamba, Chopa,Tolopa and Kachingwe on February 27, 2023 in Lusaka jointly and whilst acting together conducted themselves in a disorderly manner at Kabwata police station.

BISHOP JOHN GENERAL WANTED A R**E VICTIM’S URINE FOR PRAYERS, COURT HEARS

The Lusaka Magistrate Court has heard that Miracle Impact Ministries overseer, Pastor John Nundwe, alias Bishop John General, allegedly told a married woman whom he is accused of ra**ng that he needed her urine to pray over it so she could conceive.

Mr. Nundwe has pleaded not guilty to one count of r**e.

Testifying before Magistrate Army Masoja, the victim has testified that the bishop forced himself on her, insisting she open her legs and stop wasting his time as he had to go to church.

She claimed he r**ed her while she was on her period.

She has further testified that her husband caught the bishop in the act, prompting the accused to call for his colleague to bring a gun and kill them, however, she pleaded for their lives.

The court has also heard that the bishop later sent Apostle Christopher K***a to apologize on his behalf.

The apostle allegedly urged her to forgive him, saying such things happen and he, too, had been in a similar situation.

The victim says she only sought prayers, not s*x, and never expected such betrayal from him.
