Is the Prosecution of former ZRA Commissioner General and his Co- accused Legal?

The Zambian Whistleblower Special Correspondent has taken a keen interest in the Prosecution of Former Zambia Revenue Authority Commissioner General Kingsley Chanda and his Co accused Callistus Kaoma.

Chanda and Kaoma are jointly accused of Abuse of Authority of Office regarding the disposal of used motor vehicles.

The state has produced in court a draft asset disposal policy that the ZRA Board did not and has not approved to date.

According to evidence by the duo, the used motor vehicles were disposed of under a 2017 policy but the Prosecution produced in court a draft policy that the ZRA board did not approve.

For example, clause 3.4 of the 2017 policy was not produced in court.

Questions that beg answers are,

1. Who authorised the production of a draft policy in court?
2. Why didn't the Prosecution produce the applicable policy at the time of asset disposal?
3. What hasn't the current Commissioner General Dingani Banda who was incharge of asset disposal indicted ?

President HH should know that people distinguish facts from fiction

This idea that the United Party for National Development (UPND) government has done more for this country than any other regime since independence is a fallacy.

People should know that when a president engages in such cheap talk and reckless claims, the masses begin to wonder as to why the desperation for such unfounded self-praise and dishonesty. A good example is former president Donald Trump of the United States of America who is famous for such delusional talk and misrepresentations of facts. He loves to make all sorts of unsubstantiated claims for self-exaltation. It is unfortunate that even our very own sitting President Hakainde Hichilema (HH) is beginning to sound like he is bluffing in some of his claims. This habit should not be tolerated, because it will pollute our politics with lies and falsehoods, to a point that we will fail as a nation to undo the damage – America today is a classic example of such an outcome.

Arguably, the new dawn administration has not even achieved half of what the Levy Mwanawasa regime achieved in its first term of office. Hence, to suggest that UPND has done more than any regime for the past 60 years is an over stretch. Let us go back to the basics in qualifying this argument. Just a simple question such as which industries, factories and manufacturing has this government established? Who owns the means of production in this economy today? We all know that all strategic sectors of our economy are owned, and operated by non-Zambians; from retail chain stores i.e Shoprite, Pep Stores, Pick ‘n‘ Pay, Game Stores, etc...

The mining industry is an open secret and no exception in this regard. Just look at Konkola Copper Mines (KCM), Mopani Copper Mines (MCM), Roan Copper Mines, even the new dawn government’s newly commissioned Shaft 28 in Launshya – in North-Western Province we have Barrick Gold, Lumwana Mine, Kalumbila Mine , and a few other mines - while in Kafue we mine nickle, which are all foreign owned. Notwithstanding the gemstone mines on the Copperbelt, and other big profitable mines across the country. Perhaps if we owned these mines as government, and as the people of Zambia, maybe we will not be recording such high number of deaths by so-called illegal miners under the watch of the UPND.

Furthermore, let us also look at the construction sector controlled and sponsored by this administration through government contracts. It is sad to note that most, if not all infrastructure development projects, are outsourced with preference given to foreign entities and leaving crumbs or odd jobs for local contractors. For a country with qualified, trained, and equipped engineers, this is a shame!

Also, the banking sector is no different, all major banks in the country are not owned by Zambians. In fact, it's under this regime that we have witnessed the unthinkable as we saw two local banks that Zambians could claim ownership were forced to shut down. It's a matter of public record that the UPND government brought down the Development Bank of Zambia and went on to liquidate Investrust Bank. Regardless of what the issues may have been with these two institutions, government should have taken interest is saving these banks and provide some sort of bailout package. This would have been the right thing to do, just like we saw the Americans do to their collapsing banks in 2008-09 during the financial crisis. Anyway, it appears that Hichilema hasn't learned anything from his friends in the West, with regards to this issue.

Evidently, all these sectors thus far mentioned were all owned and controlled by the Zambian government and the Zambian people during the reign of Dr Kenneth Kaunda (KK). At that time, the mines on the Copperbelt under the Zambia Consolidated Copper Mines (ZCCM) era gave our country the best quality of life ever recorded in our history - and created sustainable jobs that paid a living wage. Therefore, how can President HH surely say with a straight face that "his regime has done more for our country, than any of his predecessors"? Is the man being serious! This is just absolutely untrue and shameful to say the least. Any well-meaning Zambian can agree without contention, with the notion that Dr Kaunda and his colleagues laid a firm foundation. Even the little development that proceeded a little after the 27 years of Dr Kaunda was all premised on the building blocks that KK left behind. His record is unmatched – by far.

At 60 years of independence, Zambia still sits comfortably among the class of nations where few have so much wealth and privileged at the expense of masses of our people. We have seen an increase in the number of homeless people, while we struggle with poor housing conditions - just look around the township or compounds surrounding the capital city, Lusaka. We have a huge population of people living below the poverty lines (less than $1) a day, within an economy that currently has an exponential growth in the high cost of living. The poor infrastructure in urban areas, and worse off in rural places puts our country in the shadows of shame. Some of the economic roads in this country have never been done since independence, while others were only worked on by President Michael Sata. Clearly, how can the UPND be better off than all the previous regime when all the facts do not agree with them?

Conversely, in terms of economic benefits, the profits made out of these companies running our industries and economic activities from various sectors do not contribute to our national treasury, but instead leave our country in broad daylight. And only to be paid off as dividends for those who own the means of production. These are the people who are pay masters of our politicians, who wine and dine with them. Honestly, how can this be a situation that is far better off for our country since 1964? How is it that President HH can claim that his government has done more for the country when the people today have massive load shedding under his watch? In some areas these power outages go up to 21 hours, or even two to three days. The levels of unemployment are off the roof, and even for those who have jobs they are cashiers and security guards at shopping malls, which is a disgrace because these jobs do not pay a living wage. Regrettable, because of such circumstances, the levels of crime have gone up in Lusaka and other urban areas. At 60 years of independence, we import everything and consume anything without production of goods and services that our people need daily. In all fairness, this is not the change that HH himself and the UPND promised the Zambian people.

The truth is that some presidents before HH created better jobs and expanded the manufacturing industries countrywide, which gave our people pride and dignity. The focus of our forebearers was to build a country that gave life to its people, especially the young ones. There was a plan for the youth, women, and children at the core of our nation building during the post-independence years. This is evident in all the programmes, and policies of government under the United National Independence Party (UNIP). For example, the recruitment of graduates into the Zambia National Service (ZNS) did two things. Number one, it instilled a sense of pride in all young people who were transitioning from higher institutions of learning into the workforce. Just those two years or so that one spent in service to our country via ZNS was enough to give young people a sense of belonging and ownership. Secondly, the ZNS recruitment and time spent in the service made sure that young people learned tangible skills that would set them up for life thereafter. This is the kind of foundation laid down by KK, which is something HH and his UPND cannot even come close to establishing.

Even though some things went wrong during the foundational years of our Republic, no one can question the spirit and intent of our forefathers. They meant well for this country, and most of them gave everything to see us to where we are. Some of the short comings that became very obvious was the intolerance to divert views among the ruling class. The undemocratic tendencies that began to surface in government institutions, and many other negative appetites. A good lesson that by now we all should have learned from and moved away from such. Unfortunately, we are beginning to see the new dawn administration becoming very intolerant to views that criticise and critique them. This is unhealthy and unacceptable. A true democracy entails that all speech is protected under the Constitution, and that no speech is censored or curtailed. Let the people speak, even when you passionately disagree with them.

President HH should be encouraged to normalise the truth, or at least have respect for facts. As president you cannot just wake up and created your own alternative reality, and make careless statements thinking that the people will agree with you. No! That is not right, even if it's a matter of opinion, because leaders have to be thorough and stick to facts as they formulate opinions and influence others.

INVOICE PRODUCED IN COURT SHOWS DESTINATION FOR ZNS GMO MEALIE MEAL IS LUSAKA.

Good Evening.

The trial of Zambian Whistleblower Chief Consultant Thomas Allan Zgambo started in Lusaka Magistrate Court today where the defence produced a Commercial Invoice which shows that the Mealie Meal containing Genetically Modified Organisms ( GMO) imported from South Africa by Zambia National Service ( ZNS) was destined for Lusaka.

During the trial, State Witness number one Chief Inspector Cyber Crime Unit Michael Ilishibo explained how he was approached by Brian Chipango a fellow officer to investigate the story which appeared on the Zambian Whistleblower page on October 17 and 26, 2023, regarding the importation of GMO Mealie Meal by ZNS.

After Brian Chipango the Investigations Officer gave him a Know Your Customer ( KYC) document from Airtel, he found that the number that appears on the Zambian Whistleblower face book page is the one Thomas Allan Zgambo donated to the Zambian Whistleblower for their use in interacting with the public.

During cross examination by defence Counsel Jonas Zimba, Chief Inspector Ilishebo admitted that he did not know Thomas Allan Zgambo was a Journalist.

When asked, he said he would also be unhappy to know he was being fed GMO Mealie Mealie but that he would not comment on Facebook. Chief Inspector Ilishebo also said he did not know ZNS Headquarters was at Corner of Church Road and Addis Ababa Drive.

He was then asked to identify and read a commercial invoice.

He said it was an Invoice from a South African Company to supply milled Maize to Eagles Milling Company Limited of Plot number 6E2, Corner of Church Road and Addis Ababa drive in Lusaka Zambia. The invoice was for the supply of 30 Metric Tonnes of GMO Mealie Meal( Breakfast) in monthly batches of 5000 Metric Tonnes.

The invoice shows the destination of the imported GMO Mealie Meal as ZNS Headquarters in Lusaka, whose location Chief Inspector Ilishebo claimed he did not know.

At this point the defence applied to court for Thomas Allan Zgambo's two phones and a laptop be brought to court so that the defence can access more information on the matter. The Court ordered that the gadgets be produced on 13th September 2024, and set 14th October 2024 as the date for continue cross examination of State Witness number one Micheal Ilishebo.

TOXIC MAIZE ISSUE SHOULD REMIND GOVT AND PUBLIC OF THOMAS ALLAN ZGAMBO

Good evening.

The frightening disclosure by Minister of Health Elijah Muchima that there is maize on the Zambian market with higher than acceptable levels of toxins raises very serious issues which the Zambian public must demand that the government should answer.

The first one is that this matter has connections with the story for which Thomas Allan Zgambo is appearing in court charged with the alleged offence of seditious practices.

Thomas' only crime is that the Zambian Whistleblower, of which he is Chief Consultant, did a story in which they asked the government to confirm whether or not the mealie meal that Zambia National Sercice (ZNS) was importing from South Africa contained Genetically Modified Organisms (GMO).

This is exactly the role which the media plays for the public good. But instead of the government and ZNS coming out to confirm or deny what was already a matter of public speculation, they decided to arrest Zgambo and charge him for seditious practices.

Is this not just criminalising journalism, so that the Zambian public is denied information about possible threats to their health.

Now the threat is even greater. The government itself has disclosed the presence of maize and maize products with harmful effects to the health of animals and humans.

There are already many individual Zambians and organisation who have come out questioning why Muchima chose not to disclose the source of the maize, and the miller's and distributors of the products already confirmed as harmful after the death of 400 dogs. The health of Zambian citizens is also under threat.

Are all the people who have asked the government to disclose the source of the maize and maize products going to be arrested for seditious practices?

If not, then why should Thomas Allan Zgambo be in court for simply being part of a publication asking the government to confirm whether ZNS was importing GMO mealie meal?

The third major issue is that the government of Dictator Hakainde Hichilema should also not shy away from discussing the source of this problem.

Everything that has been said so far is simply talking about tackling the symptoms and the disease, not the cause.

The cause of this health threat from maize and maize products has come about because of mismanagement of the country's maize stocks, arising out of greed.

This government decided to export the country's surplus maize stocks, and some of the strategic stocks, while ignoring global warnings about impending drought in Southern Africa, including Zambia.

Now that the nation is faced with shortages of maize, there is desperation to import from anywhere. That is why the question of the source of Maize is very important to be answered.

It now seems that in the process, some contaminated maize has found its way onto the Zambian market. This can only be dispelled by the government itself because citizens can not guess.

These are matters about which journalists need to write to inform the public about health threats, whether from GMO or from toxins-contaminated maize. Part of this role is fulfilled by journalists asking the government to explain issues, just as The Zambian Whistleblower did concerning the ZNS Mealie Meal.

There are a lot of questions which journalists should ask concerning contaminated maize and maize products on the Zambian market.
The Zambian Whistleblower has some of its own information on this matter. But for now, this information from our sources will be withheld.

First, the Zambian public must ask the government to explain why Thomas Allan Zgambo is in court for simply asking the government to confirm whether the mealie meal ZNS was importing from South Africa contained GMO.

Calling the government to account cannot be done effectively by journalists alone. They need the cooperation of a Zambian public more keenly aware of its own civic responsibilities.

It is also important for the public to take note of mercenaries like Andrew Chintala of the Millers Association Zambia ( MAZ) who despite not being a public health expert is assuring the nation of the safe consumption of the contaminated maize. Owning a family Hammer Mill does not make him an expert in such matters.

It would be prudent for the government through responsible ministries and the Chief Government Spokesperson to shed more light on this sad development.

The Zambian Whistleblower sympathies with many Zambains who do not know what to do in such a situation when details are scanty and the government shuts its mouth.

ZAMBIAN WHISTLEBLOWER VINDICATED OVER KASANDA AIRPORT GOLD/CASH CASE

Good evening.

The court outcome of today in the case against Shedrick Kasanda, who was charged with aggravated robbery, vindicates what the Zambian Whistleblower stated in its articles when the Kenneth Kaunda International Airport (KKIA) gold and cash scandal exploded.

The ZWB stated in many of its stories that two factors would ensure the cases do not go anywhere. The first one was that too much money had passed between the main actors and officers of the Zambia Police, security services, airport staff, and State House officials, which represented a threat to the reputation of Dictator Hakainde Hichilema's government.

The second factor was that among the Egyptians detained at that time, there were very senior military intelligence officers whom the Egyptian government wanted freed, through the use of the leverage it had because Dictator Hichilema and then Health Minister Sylvia Masebo were desperate to bulk-procure medical drugs from Egypt and end shortages of medicines in public health facilities. Part of that supply was the one which recently discovered hidden at J and J Transport leading to the transfer of Masebo and the dismissal of Munji Habeenzu and Victor Nyasulu.

The Zambian government gave in to pressure and released all the Egyptian suspects. A Zambian suspect Osward Diangamo also benefited from the Nolles. At that time, the ZWB predicted that it was just a matter of time before the cases brought against various people in connection with KKIA gold and cash scandal collapsed.

Today, Shedrick Kasanda Kapasa has been discharged on a nolle prosequi.
What has happened to Shedrick Kasanda today is just another step in the collapse of the KKIA gold and cash scandal cases. There may just be too many State House-linked persons involved in some of these KKIA cases for them to be concluded successfully.

The Zambian Whistleblower is aware of reports that the just released Kasanda has been rearrested by the Police by we are aware that there can be no successful prosecution of Kasanda and other local suspects as long as the Egyptians are not part of the case.

There is more the ZWB can comment on, but is constrained right now since there is another matter whose trial is still being conducted in camera. We will share more information about the KKIA scandal when the criminal matter against other Zambian suspects namely, Jim Belemu, Robinson Moonga, Francis Mateyo and Pilot Patrick Kawanu is disposed of.

Talking about court cases, there was an appearance by National Democratic Congress(NDC) President Saboi Imboela and Patriots for Economic Progress(PEP) President Sean Tembo, who have been sued by Levy Ngoma, Political Adviser to Dictator Hichilema, and Trevor Mwiinde, United Party for National Development (UPND) Deputy National Youth Chairman.

The two have sued Saboi Imboela, Sean Tembo and ZWB Chief Consultant Thomas Allan Zgambo for having named them as being among people whom Petauke Central Independent Member of Parliament, Emmanuel Banda, said he saw when he was abducted and tortured.

But the surprising thing is that the complaint by the two UPND officials is moving very swiftly ahead, while the complaint by the Petauke lawmaker has never been investigated.

This continues to surprise many Zambians because the people being sued were simply pushing for those Jay Jay named to be investigated.
The complaint and statement by Jay Jay Banda, in which he named Levy Ngoma and Trevor Mwiinde, has not been investigated by the Police. But proper professional police investigation of Jay Jay's complaint is what would have cleared these UPND officials, and made subsequent court action logical. For Levy Ngoma and Trevor Mwiinde to sue the people who commented on the issue simply shows that they want to obstruct investigations.

But then, justice under the government of Dictator Hichilema has put on a very strange partisan face.

Another court case recording very swift progress is that of Civil Rights activist Brebner Changala for alleged sedition. He too was in court today and the State has already closed its case, after bringing four out its previously indicated seven witnesses. Among the witnesses were Darious Choonya of Diamond Television, Bill Kapinga a UPND cadre and a Mr. Moonga the arresting officer. The matter is before Chief Resident Magistrate Chibwili and is being prosecuted by Public Prosecutor Muchimba. Brebner Changala's case could enter the country's record as the fastest case to ever reach ruling stage. Ruling on whether Mr. Changala has a case to answer or not has been set for September 12. 2024.

Lusaka, Zambia - Acton Institute for Policy Analysis Centre (AIPAC) expresses deep concern regarding Vedanta Resources' financial capacity to manage Konkola Copper Mines (KCM) effectively.

Despite assurances, Vedanta's actions raise doubts:

- Announced $245 million to pay debts to suppliers and contractors in July
- Only four entities received payments, leaving over 646 contractors and suppliers unpaid
- Failed to meet promised payment deadline of August 1

QUESTIONS OVER DICTATOR HICHILEMA'S ALLEGED CONFLICT OF INTEREST WILL CONTINUE.

Regardless of how many times Dictator Hakainde Hichilema throws us in jail, questions about his alleged conflict of interest in a number of transactions involving public resources will continue.

The latest set of questions come from the recently announced acquisition of a Zambeef owned Farming enterprise. Zambia National Service ( ZNS) Commandant Maliti Solochi and his Counterpart at Zambia Correctional Services ( ZCS) Fredrick Chilukutu are quoted by State owned Zambia Daily Mail disclosing that the Zambian Government has acquired the Chiawa Zambeef Maize plantation in order to help produce Maize for local consumption.

Like the earlier question regarding the Zambia National Public Health Institute allegedly renting offices from Saturnia, the Zambian Whistleblower believes that it is not wrong to ask questions on behalf of Zambians on matters that involve public interest.

It was previously known that Dictator Hakainde Hichilema had shares in African Life, which according to information obtained is a shareholder in Zambeef that has conveyed its Chiawa outfit to the Zambian Government, would it not have been proper if the nation was informed well in advance about this business transaction in order to avoid speculation?
Is it a crime for a journalist to seek clarification?

HICHILEMA SHOULD KNOW INDEPENDENT MEDIA OUTLASTS DICTATORS.

Good Evening.

News coming of the Philippines proves that regardless of how powerful political dictators believe they are, persecuting independent investigative journalists is a no-win situation.

This is the truth we share with you Zambians, based on what has happened in the Philippines.

Former President of the Philippines Rodrigo Duterte spent virtually his whole term in office persecuting Maria Ressa, publisher of an independent outlet known as Rappler.

Things got worse when Rappler began to question Duterte's war on drugs.

This is similar to what Dictator Hichilema has been doing against Thomas Allan Zgambo over his investigative Journalism work, which exposes poor governance, corruption and tribalism.

As has happened to Maria Ressa, truth and history will finally vindicate Zgambo and the work of the Zambian Whistleblower.

We have attached the article on the court outcome from the Philippines yesterday.

Zambian independent media will also outlast Dictator Hichilema.

A Philippine court has ordered the country's corporate regulator to restore the license of Rappler, a media firm led by Nobel laureate Maria Ressa who reported on former President Rodrigo Duterte's campaign against illegal drugs.

The Court of Appeals, in a decision dated July 23 that was seen by Reuters on Friday, had voided orders and decisions of the Philippine Securities and Exchange Commission (SEC) to shut down the online news site.

The Securities and Exchange Commission did not immediately respond to a request for comment.

The SEC in 2018 rescinded the operating license of Rappler for violating foreign equity restrictions on domestic media when it sold depositary rights to a foreign entity. The decision was upheld in 2022.

The appellate court said the SEC "acted with grave abuse of discretion" in revoking Rappler's certificate of incorporation.

Rappler had previously argued the Omidyar Network, the philanthropic arm of EBay founder Pierre Omidyar, was a silent investor. Omidyar cut ties by donating the depository receipts to Rappler's staff.

Rappler was founded by Ressa, won the 2021 Nobel Peace Prize along with Russian investigative journalist Dmitry Muratov in a decision widely seen as an endorsement of free speech rights that had come under fire worldwide.

Ressa is currently on bail after being convicted in 2020 in a cyber libel case. She has appealed the decision to the country's top court.

The Zambia National Service ( ZNS) and Zambia Correctional Service ( ZCS) have taken over the running of the ZAMBEEF CHIAWA Estate Farm in Chirundu District of Southern Province.

Government acquired the farm and handed it over to the two Services to manage.

ZNS Commander Lieutenant General Maliti Solochi and ZCS Commissioner General Mr Fredrick Chilukutu announced today that the planting of white maize on 1,200 hectares of land will start soon.

The two Services Chiefs took time off their busy schedules to tour the highly modernized estate which sits on approximately 8,000 hectares of land.

The estate has 33 functional center pivots in total.

" We are here with my colleague, the Zambia Correctional Service ( ZCS) Commissioner General Fredrick Chilukutu to inspect CHIAWA farm," Lt Gen Solochi said.

The ZNS Service Chief said President Hakainde Hichilema is working hard to ensure that Zambians have food.

"The maize and wheat which is here now will be harvested in the next three weeks and then afterwards we will start painting maize," he said.

And Zambia Correctional Service Commissioner General Mr Fredrick Chilukutu says the farm will be managed by both Zambia National Service and Zambia Correctional Service.

The ZCS Service Chief said 1,200 hectares of land is ready for use.

"Immediately, we remove the crop which is here, that includes maize and wheat we will start planting irrigated maize which will be ready to be harvested in March next year then we will come back with winter crop," Mr Chilukutu said.

He said the two institutions are equal to the task to run the farm and ensure that there is food in the country.

Mr Chilukutu thanked Government for the continued support.
