Decolonizing Family Violence Legal Intervention Orders in African-Australian Communities

Dr. Akuch Kuol Anyieth powerfully argues that the current framework of Family Violence Intervention Orders (FVIOs) in Australia fails to reflect and respect the rich cultural traditions and conflict resolution methods inherent to African-Australian communities. These legal mechanisms, rooted in Western legal paradigms, often overlook the depth and value of customary practice, practices that have, for generations provided effective community-based responses to family conflict.

In her groundbreaking book, Dr. Anyieth illustrates how the blanket application of FVIOs—without cultural nuance or context—can ultimately weaken their intended purpose. When laws are applied without understanding the socio-cultural fabric of the communities they aim to protect, they risk becoming blunt instruments that fail to resolve violence and may, in fact, exacerbate harm.

Dr. Anyieth emphasizes that the FVIO system was created without considering the diverse cultural contexts of migrant communities, particularly those who arrived after these laws were established. I

In her research, she demonstrates how the failure to incorporate cultural perspectives into legal responses to family violence not only undermines the effectiveness of intervention orders but can also deepen mistrust between African-Australian communities and the justice system.

To truly protect and empower these communities, there must be a shift toward decolonizing the legal process by integrating traditional knowledge, cultural understanding, and community engagement into family violence interventions.
