Sri Lankan music copyright violation has a deep, untold, and deeply unhinged history. Since both authors and performers have lacked proper knowledge of intellectual property and music copyright, they have repeatedly been fooled—by each other and by many commercial parties, electronic medias - time and time again.
Performers made the first move in copyright violation by taking musical creations from place to place wherever they could gain the maximum commercial benefit. In many instances, they sold the same popular songs to multiple record labels within a period of less than a single year. This particular unethical practice resulted in multiple sound recordings of the very same song. While these may be called different versions, no country with a respected and properly regulated music industry would allow such a practice.
These recordings cannot be meaningfully distinguished from one another because they are performed by the same artist. Such conduct violates the rights of the author as well as the rights of the first record label that lawfully invested in and produced the original sound recording. This type of infringement cannot be justified by any copyright law that has ever existed or currently exists anywhere in the world.
In most cases, performers initiate a song by requesting a lyricist and a composer to create it. The performer pays both parties to produce the work, but fails to understand that such payment is not a perpetual acquisition of copyright. They hypothetically believe that paying for the creation means they own the creation itself. In reality, copyright ownership does not automatically transfer simply because a fee has been paid.
At the end of the day, the performer is often the one who is ultimately fooled by a record label that purchases the master recording for a one-time payment. Without understanding how to protect their own neighboring rights and commercial interests so they can continue benefiting from their performances for decades, many performers today find themselves deprived of long-term income. Instead of recognizing where the real problem lies, they blame authors and make misguided and irresponsible statements about copyright law.
ශ්රී ලංකාවේ සංගීත ප්රකාශන හිමිකම් උල්ලංඝනයකට ගැඹුරු, නොකියූ සහ නොගැලපෙන ඉතිහාසයක් ඇත. කතුවරුන් සහ ගායන ශිල්පීන් යන දෙදෙනාටම බුද්ධිමය දේපළ සහ සංගීත ප්රකාශන අයිතිය පිළිබඳ නිසි දැනුමක් නොමැති බැවින්, ඔවුන් විටින් විට - එකිනෙකා විසින් සහ බොහෝ වාණිජ පක්ෂ, විද්යුත් මාධ්ය - යන අයගේ නිතර රැවටීමට ලක්ව ඇත.
රංගන ශිල්පීන් උපරිම වාණිජ ප්රතිලාභ ලබා ගත හැකි තැනින් තැනට සංගීත නිර්මාණ ගෙන යාමෙන් ප්රකාශන හිමිකම් උල්ලංඝනය කිරීමේ පළමු පියවර ගත්හ. බොහෝ අවස්ථාවන්හිදී, ඔවුන්ගේ එකම ජනප්රිය ගීත වසරකටත් අඩු කාලයක් තුළ බහු නිෂ්පාදක හෝ ලේබල්වලට විකුණා දැමූහ. මෙම සදාචාර විරෝධී භාවිතයේ ප්රතිඵලයක් ලෙස එකම ගීතයේ බහු ශබ්ද පටිගත කිරීම් සිදු විය. මේවා විවිධ අනුවාද ලෙස හැඳින්විය හැකි වුවද, ගෞරවනීය සහ නිසි ලෙස නියාමනය කරන ලද සංගීත කර්මාන්තයක් ඇති කිසිදු රටක් එවැනි භාවිතයකට ඉඩ නොදේ.
මෙම පටිගත කිරීම් එකිනෙකින් අර්ථවත් ලෙස වෙන්කර හඳුනාගත නොහැක, මන්ද ඒවා එකම ගායකයා හෝ ගායිකාව විසින් සිදු කරනු ලබන නිසාවෙනි. එවැනි හැසිරීම කතුවරයාගේ අයිතිවාසිකම් මෙන්ම මුල් ශබ්ද පටිගත කිරීම සඳහා නීත්යානුකූලව ආයෝජනය කර නිෂ්පාදනය කළ පළමු නිෂ්පාදක හෝ වාර්තා ලේබලයේ අයිතිවාසිකම් ද උල්ලංඝනය කරයි. ලෝකයේ ඕනෑම තැනක පවතින හෝ දැනට පවතින කිසිදු ප්රකාශන හිමිකම් නීතියකින් මෙම ආකාරයේ උල්ලංඝනයක් සාධාරණීකරණය කළ නොහැක.
බොහෝ අවස්ථාවන්හිදී, ගායකයින් ගීතයක් නිර්මාණය කර ගැනීම ආරම්භ කරන්නේ ඒ සඳහා ගීත රචකයෙකු සහ සංගීත නිර්මාපකයෙකුගෙන් එම සේවාව ඉල්ලා සිටීමෙනි. ගායන ශිල්පියා කෘතිය නිෂ්පාදනය කිරීම සඳහා දෙපාර්ශවයටම එම සේවාව වෙනුවෙන් මුදල් ගෙවන නමුත්, එවැනි ගෙවීමක් යනු ප්රකාශන හිමිකම සදාකාලික අත්පත් කර ගැනීමක් නොවන බව තේරුම් ගැනීමට අපොහොසත් වේ. නිර්මාණය සඳහා ගෙවීම යනු නිර්මාණය ඔවුන් සතු බව ඔවුන් වැරදි උපකල්පනයෙන් විශ්වාස කරයි. යථාර්ථය තුළ, ගාස්තුවක් ගෙවා ඇති පමණින් ප්රකාශන හිමිකම ස්වයංක්රීයව මාරු නොවන බව ඔවුන් නොදනී.
අවසානයේදී, ගායන ශිල්පියා බොහෝ විට ප්රධාන පටිගත කිරීම එක් වරක ගෙවීමකට යටත්ව මිලදී ගන්නා වාර්තා ලේබලයකින් අවසානයේ රැවටෙන්නේය. දශක ගණනාවක් තිස්සේ ඔවුන්ගේ ගායනාවන් ගෙන් ප්රතිලාභ ලබා ගැනීම සඳහා ඔවුන්ගේම ආසන්න අයිතිවාසිකම් සහ වාණිජ අවශ්යතා ආරක්ෂා කර ගන්නේ කෙසේද යන්න තේරුම් නොගත් නිසා, අද බොහෝ ගායන ශිල්පීන්ට දිගුකාලීන ආදායම් අහිමි වී ඇත. සැබෑ ගැටළුව ඇත්තේ කොතැනදැයි හඳුනා ගැනීම වෙනුවට, ඔවුන් කතුවරුන්ට දොස් පවරන අතර ප්රකාශන හිමිකම් නීතිය පිළිබඳව නොමඟ ගිය සහ වගකීම් විරහිත ප්රකාශ නිකුත් කරමින් සිටිති.
