Friday's Federal Court hearing contained an extraordinary statement from government lawyers that should have all Australia's worried.

ABC reports that lawyers for Australian citizen and father of six told the Federal Court the extradition should be void because the alleged action was not a crime in Australia at the time.

In response lawyers for the Attorney General told the Court that was not Australia's concern - it was for the United States to determine guilt or innocence of this Australian citizen.

Saffrine spoke outside of court yesterday before the federal court hearing in which Dan and his legal team challenged the approval of his extradition.

The facts of the case cannot be argued in an Australian court.

The judge will now consider the information presented by Dan's legal team and legal team representing the Attorney-General.

The family is so grateful to the man who has given so much, “a home to live in, endless generosity and a love that anchors us through it all.”

He is devastated by what has happened to Dan, calling it “ridiculous”.

Day 1089 of incarceration for Dan. We are hoping come Thursday the Duggan's will finally see some justice, that Dan's case will be taken seriously by the Federal Court and he can come home to his loving family.

"I've had to explain the unimaginable to my kids. Whilst we are feeling good for the up and coming, hoping that the court system and our government will make the right choice and just let Dan come home to his children. It is also extremely nerve racking having to go through these phases with the legal system." -Saffrine Duggan speaking recently about Dan and the Federal Court case.

Thursday is the pinnacle of three years of pain, torture, mental and financial hardships. What this family has had to endure is beyond imagination. Blow, after blow, after blow. Yet, somehow they've managed to continue on. Building up to this day in court.

With the federal court appeal next week, the Duggans are still short $22,000 to pay the barrister to appear.
They cannot access legal aid and their property was seized so donations are the only way to fund the proceeding.

This challenge is not only vital for Dan, Saffrine and the six children, but also as a fight for Australian sovereignty, for justice and against the extraterritoriality of the United States.

This time next week Dan will be facing the Federal Court to have his extradition charge overturned.

We hope that the court will consider the facts thoroughly, unlike the AG's office and our government.

-Dan is an Australian citizen

-There have been no Australian charges laid

-Dan reported his earnings to the ATO

-Dan was training civilian pilots

-Dan has never had a criminal record, nor has he been arrested for anything prior.

It's been a tumultuous 3 years with many lows and very little highs for the family. Dan's children need their father, Dan's wife needs her husband, Dan's friends need their mate.
