Dan Duggan is missing his children’s end of year celebrations, awards ceremonies and performances. His youngest son is graduating from primary school and Dan cannot be there.

He broke no law in training civilian pilots in South Africa on a part time basis back in 2012.

The Australian government is allowing him and his family to be traumatised, punished – all to fulfil a political agenda.

The Attorney-General could release Dan at anytime, instead she is letting the Duggans be bankrupted fighting her department in court.

According to ABC News - a delegation of United Nations inspectors has delivered a scathing assessment of Australia's treatment of prisoners and other detainees, following a 12-day visit to the country.

The UN Working Group on Arbitrary Detention (WGAD) Chair, Ukrainian lawyer and former European Human Rights court judge Dr Ganna Yudkivska, said that the 42 per cent of prisoners that were unsentenced in Australian prisons meant almost half of the country's prison population was "legally innocent".

"Bail laws have been repeatedly tightened, often because of what we see as populist reactions to some headlines in media about high-profile crimes rather than based on evidence," she said.

Dan Duggan has been locked up since October 21, 2022, facing no Australian charges. He spent over 19 months in solitary confinement, a breach of United Nations rules and considered to be torture.

Dan Duggan has been locked in maximum security for over 3 years, having broken no Australian law, on US allegations stemming from a short work contract instructing test pilots way back in 2012 in South Africa.
The Australian government could end his nightmare at any time.

Every phone call between the Duggans is precious. It has been over three years since Dan’s arrest and incarceration and with only one day a week allowed for visiting, phone calls are a lifeline for the family.

Dan’s calls are restricted to 10 minutes before they cut out. They are charged at STD rates, so they are costly for the family.

Dan faces no Australian charges, yet has been locked up since October 2022. The Attorney-General has the power to set Dan free at any time.

Instead, the Duggans have had to appeal Dan’s extradition approval in the Federal Court at great financial expense.

Dan has lived in Australia since 2002.

He was a part time instructor for an international flight school instructing civilian test pilots in South Africa.

There were no aircraft carriers in South Africa, and Dan worked minimal hours in 1960s planes, certainly not the hundreds of hours to teach and certify a pilot in landing on an aircraft carrier.
Why is the Australian government agreeing to send an Australian citizen to a foreign country to defend himself on allegations that weren’t a crime in his home country?

Australia has not, and will not look at the case against Dan, even though the indictment was cobbled together, came after a special extension to the statute of limitations and the US - specific charges are against an Australian citizen, not a US one.

The injustice is baffling. The Attorney-General could free Dan and reject the extradition.

Noelene Isherwood, Co-founder of the Australian Citizens Party spoke before Dan’s court hearing on behalf of Terry Dwyer who has become a friend to Dan during his incarceration.

Dan is a loving father who just wants to go home to his family.

He broke no Australian law and faces no charges in Australia.

The Duggans are not concerned about the social media ban today. The children experience the trauma of visiting an innocent father in prison each week .

The UN emphasised in their Committee on the Rights of the Child in September 2011 that: “the best interests of the child should be the central consideration at all stages of the process relating to the incarceration of a parent” and recommended that: “Alternatives to detention should be made available and applied on a case-by-case basis, with full consideration of the likely impacts of different sentences on the best interests of the affected child(ren).”

The NSW Government were given 40 recommendations by the Committee on Children and Young People in its report into Support for children of imprisoned parents in New South Wales.
The NSW Government recognised the traumatic effects of separation of families due to parental incarceration, and the possible negative flow-on impacts on children of imprisoned parents.

And yet…

Dan was put into solitary confinement for 19 months and has remained in maximum security for over 1,100 days. No bail, no home detention, no release, all without facing Australian charges.

It is bad enough that the Duggans have been so emotionally traumatised by the US singling out and scapegoating Dan Duggan, when no so-called co conspirators and no-one from the flight school has faced any charges –

But they continue to struggle to pay legal fees and afford Christmas.

Their home was seized, they can’t get legal aid and Dan can’t work and legal bills continue to pile up whilst they try to get Dan home.

Saffrine has continued fighting for her family and for justice for Dan.

The arrest and incarceration of her husband is heartbreaking, but the family continues to fight on with strength, determination and optimism.

This year she has met with politicians, made media appearances, supported Dan in court, held an art exhibition, ran an actual marathon, all whilst raising six kids as a forced single mother.

The ongoing battle for justice has been worsened by the financial strain of funding lawyers, experts and the increased cost of living for the family.

With the end of the school year approaching, it is a bittersweet time for the family. Dan’s youngest son will graduate from primary school and Dan won’t be there.

He has now missed 3 years of school events, birthdays, firsts and lasts. This Christmas could be the fourth the family spends it without him.

The Duggans still maintain hope that the government and the courts will bring him home to his family.

John Kiriakou is a former US intelligence officer, author and whistle blower who spoke to Consortium News recently about Dan’s case.

He pointed out a number of points that just don’t add up.

Dan was and is an Australian citizen, he wasn’t an American citizen at the time of the alleged offence.

“Did he intend to violate the law? Obviously not.” – John Kiriakou.
The US has discounted criminal intent. Criminal intent is a required element in proving a crime. There was no criminal intent. It wasn’t even a crime in Australia at the time.

Also, why was Dan the only one arrested from that flight school? Everybody who was training “foreign nationals” at that flight school should have been arrested, if indeed the motive of the arrest was to stop the training of Chinese pilots.
