Member States can, in theory, escape from the obligation to recover state aid that the Commission has found to be incompatible with the internal market if they can demonstrate that it is absolutely impossible. When they appear before the Court of Justice of the EU [CJEU] for failing to recover incompatible aid, they always claim but rarely succeed to prove absolute impossibility. The standard set by the CJEU is very high.

Similar claims of absolute impossibility were rejected on 13 November 2025 by the CJEU in its judgment in case C-632/23, Commission v Bulgaria.[1] The Commission had asked the CJEU to confirm that Bulgaria failed to recover incompatible state aid following Commission decision 2015/456. The Commission had concluded that swaps of forest land involved valuation at artificial prices that constituted state aid.

Sometime after the fall of communism in Bulgaria, the government decided to return confiscated forest land to the original owners. To facilitate this process, it also decided to swap state forest land for privatised forest land of equivalent value. The problem was that the value of the land was determined on the basis of a method laid down by the relevant law. Administrative prices did not correspond to market prices ...

State aid that is granted after the start of works lacks incentive effect and cannot be compatible with the internal market. However, state aid may enable the expansion of a project that has already started. The aid may be compatible if the expansion was not foreseen when the project was launched and if the subsidised costs are different from the costs that were initially foreseen.

Recently Italy notified to the Commission a measure to support the expansion of a multimodal freight terminal near Bologna. The measure provides aid in the form of direct grants totalling EUR 24.5 million, in nominal terms. The Commission approved it on 2 October 2025 in decision SA.118718.

The current terminal which is operated by Interporto Bologna is expected to reach full capacity in about ten years. The state aid will finance the modernisation and expansion of the existing intermodal facility and to facilitate the transfer of freight from road to rail. This transfer of freight will relieve road congestion and reduce air pollution ...

The Commission, in its 2016 Notice on the Notion of State Aid, made an important distinction between “indirect” beneficiaries and “secondary” beneficiaries of state aid. All state aid measures have secondary effects for the simple reason that direct aid recipients do not function in isolation from the rest of the economy. When they spend the aid they receive, third parties benefit too [e.g. the manufacturer of the equipment that is purchased with the help of the aid]. The crucial difference between secondary and indirect beneficiaries is that the secondary ones are not identified or otherwise specified in the aid measure. By contrast, third parties become indirect beneficiaries when the aid measure requires the direct aid recipients to pass on the aid to identified or specified third parties. Then the Commission must assess, first, whether there is state aid for indirect beneficiaries [e.g. whether they are undertakings], in addition to direct beneficiaries and, second, whether any such aid is compatible with the internal market.

On 16 October 2025, the Court of Justice of the EU [CJEU] in case C-59/24 P, Netherlands v European Gaming and Betting Association & Commission had to answer the question whether the Commission was obliged to examine the presence of indirect aid when the notified measure concerned solely the direct beneficiaries ...
