Can Member States use national procedural rules to delay the recovery of unlawful State aid?

A new analysis by Phedon Nicolaides examines a recent CJEU judgment that reinforces one of the strictest principles of EU State aid law: recovery must be immediate and effective.

The Court found that:

• automatic suspension of recovery procedures is incompatible with EU law
• guarantees do not necessarily eliminate the competitive advantage of aid
• repayment in instalments may undermine effective recovery
• Member States cannot rely on national rules to avoid enforcement of Commission recovery decisions

The judgment leaves very little room for delaying the recovery of incompatible aid.

Can Member States delay the recovery of unlawful State aid through national procedural rules?

A new analysis by Phedon Nicolaides examines a recent CJEU judgment on the limits of national procedural autonomy in State aid recovery.

The Court makes clear that:

• automatic suspension of recovery procedures is incompatible with EU law
• repayment in instalments may undermine the requirement of immediate and effective recovery
• guarantees do not necessarily remove the competitive advantage enjoyed by beneficiaries
• Member States cannot rely on domestic procedural rules to avoid enforcing Commission recovery decisions

The judgment reinforces a core principle of EU State aid law: unlawful and incompatible aid must be recovered without delay.

Can formally objective criteria still amount to selective State aid?

A new judgment from the General Court suggests they can.

In Carpatair v Commission, the Court examined airport charge reductions that were theoretically open to all airlines — but in practice only a very limited category of operators could realistically benefit.

The judgment raises broader questions:

• When do “neutral” market criteria become selective in effect?
• Can objective thresholds still favour specific undertakings?
• How far should courts look beyond the formal wording of a measure to its practical consequences?
• And what must competitors prove to challenge Commission State aid decisions successfully?

The ruling also reiterates that operating in the same market is not enough: competitors must demonstrate a substantial adverse effect on their competitive position.
