Nnamdi Kanu’s trial, a threat to Nigeria’s democracy – Njoku

ABUJA – Barrister Njoku Jude Njoku, a UK-based human rights lawyer, has accused the federal government of violating local and international laws in the extradition and trial of Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB).

In a statement issued Tuesday in Abuja, Njoku warned the case threatens Nigeria’s democracy and rule of law.

Njoku criticized Kanu’s forced extradition from Kenya without judicial authorization, calling it a breach of the African Charter on Human and Peoples’ Rights.

He also condemned the Supreme Court’s December 2023 ruling in FRN v. Nnamdi Kanu for prioritizing executive convenience over constitutional principles.

“Justice, if it must stand, must not be built on a foundation of illegality. Kanu’s case is not simply about a man; it is about whether the Nigerian state remains bound by law or has become an arbiter above it,” Njoku stated.

The lawyer highlighted legal violations, including bypassing fair hearing requirements under Kenyan and Nigerian laws. He also criticized the shift from treasonable felony to terrorism charges, noting jurisdictional issues under Nigeria’s Extradition Act.

Njoku said: “Nigeria, by forcibly abducting Kanu from Kenya without judicial authorization, flouted both the African Charter on Human and Peoples’ Rights and binding obligations under Commonwealth extradition frameworks.

“The Supreme Court’s refusal to uphold these standards weakens public confidence in the judiciary’s independence and constitutional fidelity.”

The legal expert accused the government of disregarding Commonwealth extradition frameworks and international law. He referenced the Court of Appeal’s 2022 ruling, which discharged Kanu due to fair hearing breaches, and warned the Supreme Court’s reversal sets a dangerous precedent.

Njoku warned, “The Supreme Court ruling by Justice Garba sets a dangerous precedent for future cases, potentially weakening due process protections in extradition and related cases, risking increased international criticism.

“It is the jurisprudential maxim in every English Common Law country in the world, (which Nigeria is one) that you cannot place illegality on legality and expect it to stand,” Njoku concluded. “The concern about placing an illegality atop legality should agitate the minds of those involved in this high-profile case.”

Transcription Of First Witness Comprehensive Testimony:

In 2015, he was sent on a mission with his team to arrest Mazi Nnamdi Kanu at the golden Tulip hotel Lagos. He went with his team to the hotel, but the hotel management would not allow them as the management claimed they didn’t have any guest by the name Nnamdi Kanu."

Thus, the DSS Director of operations ordered a room- room search be conducted in the aforementioned hotel."

"The extraction team went back to the hotel, met with the manager and told them the instructions they got from the DSS leader.
They were then told that the suspect, Mazi Nnamdi Kanu was in room 303."

"At first, the IPOB leader Nnamdi Kanu resisted arrest upon approachment to his room but Bolaji a member of the team, spoke to him mildly and he calmed down.

Late gospel singer, Osinachi’s husband sentenced to de@th by hanging

Justice Nwosu-Iheme of a FCT High Court Wuse Zone 2 in Abuja today April 28, sentenced the husband of late gospel singer, Osinachi, Peter Nwachukwu, to de@th by hanging.

This was after the court found Nwachukwu guilty of culpable hom!cide resulting in the de@th of the celebrated singer on April 8, 2022.

While delivering his judgment, Justice Nwosu-Iheme held that the prosecution had proven the burden of proof placed on it by the law and subsequently found the defendant guilty.

Nwachukwu first was arraigned on June 3, 2022, by the Office of the Attorney-General of the Federation (OAGF), on behalf of the Federal Government, on a 23-count charge.

The charge was on culpable hom!cide punishable with de@th, criminal intimidation, cruelty to children, criminal intimidation of children, spousal battery, among others.

The prosecution team presented seventeen witnesses including two children of the late Osinachi, who testified as fourth and fifth prosecution witnesses, PW4 and PW5, respectively.

The prosecution also tendered 25 documents as exhibits before the court.

The defendant testified for the defence and further called four other witnesses and tendered four exhibits in his defence.

Shortly before sentencing, the defendant, counsel, Reginald Nwali, in his allocutus pleaded with the court to be lenient in its judgment.

Similarly, the prosecution counsel, Mrs Aderonke Imala, urged the court to give force to the law as stipulated.

Delivering his judgment, the presiding judge thereafter sentenced Nwachukwu to de@th by hanging on Count 1, while he was sentenced to two years imprisonment each on Counts 2, 3, 8,9, 12, 13, and 18.

The court sentenced the defendant to six months imprisonment on Count 10, three years imprisonment in Count 11, while he was fined the sum of N500,000 and N200,000 respectively on Counts 6 and 7 respectively.
