📜 Extended Appeal in the Light of Islamic Sharia and Justice
In Defense of Nimisha Priya — A Case of Self-Defense and Desperation
Respected Authorities,
We humbly submit this appeal for reconsideration of the death sentence against Nimisha Priya, an Indian citizen convicted of killing a Yemeni national. While acknowledging the gravity of the incident, it is essential to present the Islamic perspective on cases of severe oppression, prolonged abuse, and acts taken in self-defense and desperation.
📖 Islamic Principles on Self-Defense (الدفاع عن النفس)
Islamic Sharia permits a person to defend themselves from life-threatening oppression, harm, and severe abuse when no other option is available.
Allah says in the Qur'an:
“And if anyone is wrongfully treated, then has retaliated proportionally after being wronged — there is no blame upon them."
(Surah Ash-Shura 42:41)
And:
"Whoever transgresses against you, then transgress against them in like manner as they transgressed against you." (Surah Al-Baqarah 2:194)
Additionally:
"But if one is forced by necessity, without willful disobedience nor transgressing due limits, there is no sin upon him. Verily, Allah is Oft-Forgiving, Most Merciful." (Surah Al-Baqarah 2:173)

Precedent from the Hadith
The Prophet Muhammad ﷺ said:
If anyone is killed while defending his property, he is a martyr; if anyone is killed while defending himself, he is a martyr; if anyone is killed while defending his religion, he is a martyr; if anyone is killed while defending his family, he is a martyr."
(Sunan Abi Dawood, 4772; Sahih al-Jami, 6524)
This Hadith clearly establishes that taking action in self-defense — when one's life, dignity, and safety are in danger — is not a punishable crime in Islam.
📜 The Actual Intention Behind the Act
It is important to clarify that Nimisha Priya had no intention of killing Talat Mehdi.
According to available records and statements:
Her sole objective was to temporarily sedate him using sleeping medication in order to recover her confiscated passport and escape from Yemen
Nimisha Priya had been subjected to ongoing physical, emotional, and sexual abuse.
She was held against her will with her legal documents forcibly taken. Repeated complaints were lodged with the authorities, and the alleged abuser had previously been arrested for his crimes but was later released. Finding no legal, diplomatic, or safe alternative, she acted out of desperation to secure her freedom.
The unfortunate death was accidental resulting from an overdose of the sedative. It was not a premeditated murder.
In Islamic law, acts committed without the intention to kill, especially under duress or in self-defense, are considered with leniency and treated differently from intentional murder

📖 Islamic Law on Qisas and Diyah (Retribution and Compensation)
Islamic law allows for Qisas (legal retribution) but also permits the victim's family to accept Diyah (blood money) or to pardon the offender:
"But if the killer is forgiven by the brother of the slain (relatives), then grant (pardon) and payment in fair terms. (Surah Al-Baqarah 2:178)
Thus, even in cases of intentional killing, Islamic Sharia provides a path of mercy and reconciliation.
📜 Our Humble Plea
In light of the above Qur'anic verses, Hadith, and circumstances:
We respectfully request the authorities to reconsider this case under the provision of self-defense and extreme duress, Recognize that the killing was unintended and an unfortunate outcome of a desperate attempt to escape oppression.
Alternatively, grant an opportunity to negotiate Diyah (blood compensation) with the deceased’s family.
If possible, consider presidential clemency (رحمة) based on humanitarian and Islamic values of mercy, especially towards a woman who endured prolonged suffering and had no legal or safe recourse.
📖 Islam Emphasizes Mercy
The Prophet Muhammad ﷺ said:
"Be merciful to those on the earth and the One above the heavens will have mercy upon you."
(Sunan al-Tirmidhi 1924, Sahih)
📜 Conclusion
This appeal is not to justify the act but to contextualize it within Islamic jurisprudence's compassionate framework, which allows for mercy and understanding in circumstances of unbearable hardship and imminent threat to life.
We sincerely pray for wise, fair, and merciful judgment, in line with the noble principles of Shariah and the compassionate tradition of the Prophet Muhammad ﷺ.
