የቤተሰብ አክብሮት መሬትዎን ሊያስነጥቅዎት ይችላል? (ይርጋ የማይሠራበት 4ኛው አስደናቂ ምክንያት!)

"ዘመዴን እንዴት እከሳለሁ?" ብለው በማክበርና በመፍራት ዝም ማለታችሁ ንብረታችሁን በይርጋ እንደሚያሳጣችሁ አስበው ያውቃሉ? ነገር ግን ሕጉ እጅግ የሚገርም ከለላ አለው!

⚠️ ታሪካዊ ውሳኔ! "ከጋብቻ በፊት በስሜ የገዛሁት ቤት ፍቺ ላይ ይካፈላል?" ለምትሉ... የፌዴሬሽን ምክር ቤት የመጨረሻ አስገዳጅ ውሳኔ ሰጠ! ⚖️🏠

ቀደም ሲል የሰበር ሰሚ ችሎት "ከጋብቻ በፊት የነበረ ቤት በጋብቻ ውስጥ በጋራ ገንዘብ ከተሻሻለ የጋራ ንብረት ሊሆን ይችላል" የሚል አቅጣጫ ነበረው።

ነገር ግን የፌዴሬሽን ምክር ቤት ይህንን የሰበር ውሳኔ ሙሉ በሙሉ ሽሮታል! ምክር ቤቱ እንዳረጋገጠው፦
✅ ከጋብቻ በፊት የነበረ የግል ንብረት በጋብቻ ውስጥ ስለታደሰ ብቻ ወደ የጋራ ንብረትነት ሊቀየር አይችልም። ይህ በሕገ መንግስቱ አንቀጽ 40(1) የተረጋገጠውን የግል ንብረት የማፍራት መብት ይጥሳል።
✅ አዲሱ ሕጋዊ መመሪያ፦ ፍቺ በሚፈጠርበት ጊዜ ቤቱ የግል ንብረት ሆኖ ይቀጥላል። በጋራ የፈሰሰው ገንዘብ ካለ ግን ግማሹ በገንዘብ ተሰልቶ ለሌላኛው ወገን ይካሳል።
