Harare was left stunned today as heavily armed riot police set up camp outside Biti Law Chambers in Milton Park, sparking widespread speculation about an expected gathering by the Constitution Defence Forum the civic group headed by prominent lawyer and opposition figure Tendai Biti.

Witnesses reported security trucks, shields, helmets, and anti-riot gear lined up outside the legal offices from early morning, creating an atmosphere of tension and confusion.

But Biti, speaking from Chiredzi, dismissed the police presence as nothing more than “psychotic paranoia” by the Zimbabwe Republic Police. He insisted there were no planned protests or meetings at his offices, accusing authorities of overreacting and manufacturing drama where none existed.

As questions mount about the purpose of the unusual deployment, critics say the heavy-handed show of force exposes the state’s growing fear of civic activism even when its leaders are nowhere near the capital.

Advocate Thabani Mpofu: CHARADE OR OPPOSITION?

The beauty of a legal process is that it can be anticipated and predicted with ease. There are two sets of incompatible defences that can be advanced to the Constitutional litigation instituted. The choice depends on the purpose of the application. If respondents want to harvest any benefit from the filed applications, my prediction is that their responses would be as I set out below:

ED is likely to present himself as a constitutionalist and argue that he is bound to uphold the grundnorm, whatever it says. To keep himself clean, he will not wade into the merits of the dispute.

ZANU PF will likely go political and wax lyrical about the voice of the people.

Mabhiza will likely say she has nothing to do with any party resolution, while maintaining that the constitution can be amended and that the subject matter here is probably amendable.

Ziyambi must be the main actor. He will likely acknowledge the ZANU PF resolution, indicate that it’s lawful for the governing party to require of him action and thereafter contend on the merits that a referendum is unnecessary. The acknowledgment that he is bound to obey the resolution will be meant to demonstrate that a live controversy exists between the parties and so the court is duty bound to pronounce on it. Substantively, expect Ziyambi to parrot the BBI position.

If the application is met along these lines, it will become apparent to even the dull and ignorant why the challenge should not have been brought. But then, Zimbabwe is a democracy.
