Half the world lets you leave your estate to whoever you choose. The other half does not, and reserves a fixed share for your children whatever your will says. The line between those two systems runs straight through most cross-border families.

England and Wales raised the statutory legacy, the fixed sum a surviving spouse takes ahead of the children, to GBP 322,000 on 26 July 2023. France has allowed a disinherited child with an EU connection to claw back value from French assets since 1 November 2021, even where the deceased validly chose a foreign law. Japan made registration of inherited real estate compulsory from 1 April 2024, with pre-2024 inheritances due by 31 March 2027.

The EU Succession Regulation has applied since 17 August 2015 and picks one law to govern an entire cross-border estate in the participating member states. The default is habitual residence at death, and a person can override that by expressly electing the law of a state whose nationality they hold. Three jurisdictions people routinely assume are covered are not: England and Wales never opted in, Ireland never opted in, and Denmark sits outside it entirely.

Where a testator with full testamentary freedom holds property in a forced heirship country, the conflict resolves asset by asset rather than estate-wide.

The rule worth taking from it: one will per jurisdiction holding real estate, each drafted so it does not accidentally revoke the others.

Professor Azzedine Kettani joined the Casablanca Bar on 16 July 1968, after starting out as a law professor at the University of Rabat. Three years later he founded the practice that became Kettani Law Firm, now more than 120 legal and administrative professionals and one of Morocco's largest independent firms.

His work centres on arbitration and complex commercial disputes. He has sat as sole arbitrator, tribunal chair and tribunal member, and acted as counsel, in domestic and international proceedings across banking, insurance, infrastructure, energy, aviation and telecommunications. He holds a law degree from the University of Rabat, a doctorate in law from the University of Paris and a PhD from the University of Nice.

He has served on ICSID annulment committees, including in Malicorp v. Egypt and Lemire v. Ukraine, advised government commissions on arbitration, corporate and family law reform, and contributed to Morocco's modern arbitration legislation.
