From 1 September 2025, the Failure to Prevent Fraud offence under the Economic Crime and Corporate Transparency Act 2023 (ECCTA) has officially come into force.

This means large organisations can now be held criminally liable if they profit from fraud committed by an employee, agent or 'associated person' without having proper prevention procedures in place - even if senior management had no knowledge of the fraud.
