In 2020, Hart published The Right to Strike in International Law, a monograph developed in direct response to claims by members of the ILO Employers Group that the right to strike is not protected under international law—particularly under ILO Convention 87 on freedom of association.

The authors, through rigorous legal analysis, found no credible basis for that claim. In late 2023, the ILO referred the dispute to the International Court of Justice for an advisory opinion.

Oral arguments concluded today, and Hart’s publication served as a key reference for those defending the right to strike before the ICJ. As the Court deliberates, this book remains essential reading.
