From January 2026, significant legislative changes to Fiscal Representation in France using Regime 42 DDP will come into effect.

As your freight forwarder, we have conducted thorough due diligence and worked closely with our fiscal partners to fully understand these upcoming changes and ensure the necessary measures are in place

We have written confirmation from the Deputy Director of the French Tax Administration:

➡️ NON-EU companies will no longer be permitted to use limited tax representation (Regime 42) in France.

It is important to clarify that, contrary to some misconceptions, UK companies are not exempt from this legislative change. From January 2026, UK companies will no longer be able to use Limited Tax Representation, Regime 42 DDP in France.

We understand the potential impact this may have on your supply chain. We are prepared to help you navigate these changes smoothly, whether you are looking to maintain DDP or explore alternative solutions. We have tailored solutions available to meet your business model and operational needs.

What are your options?

1️⃣ Option 1: Obtain a French VAT number

Obtain a French VAT number and continue to ship DDP through France using Regime 40

2️⃣ Option 2: DAP, Regime 42 in France

Limited tax representation under regime 42 remains available to EU-established businesses. By changing your Incoterms to DAP, we can continue to offer VAT-exempt shipments in France by using our fiscal partner's Global VAT number. Your customer would then handle an intra-Community acquisition and Intrastats (if applicable) as they do now.
