“Can I dismiss someone in their first week?”

Short answer: you still need a fair, documented process, even in week one.

Never dismiss for: pregnancy, union activity, whistleblowing, discrimination.
You can dismiss for: gross misconduct, clear unsuitability/capability, redundancy (with process), statutory ban and some other substantial reason.

Key requirements:
• Follow appropriate procedure
• Document everything
• Full consultation
• Provide written reasons

Tribunal claims can cost thousands and drag on for months and even longer - even if you win.
