Some of you will know about my battle with the Swansea planners over the allotment shed in Horton. Well I’m pleased to report that we have finally been granted planning permission. This came after 2 years, four applications and one appeal. We even made the Evening Post! This was certainly one of my more bizarre cases. Stuck at home now in the middle of the pandemic I’m seriously considering writing the novel.

Good recent appeal decision in the ongoing HMO battle with Swansea. Conversion of a rather crumby 2flat house on
Mansel Street close to the City centre into a 6 bed HMO refused by Swansea simply because the politicians insist on refusing all applications regardless of the circumstances. The Inspector quite rightly looked at all the details and reached the decision that they were sufficient in this case to set aside policy. I wonder if the Council will try taking this one to judicial review?

I posted last year that we had obtained a blow for common sense when winning an appeal for a change of use of a large terraced property in Swansea to a HMO. Upset by the decision, Swansea Council made an application for judicial review of the decision on the basis that the Inspector had misinterpreted the relevant planning policy. I am pleased to report, however, that the judge refused the request for the review. He reasoned that in the circumstances of the case the Inspector could not have reached a different conclusion, regardless of the policy. I understand the wish of the Council to limit the number of new HMOs going forward but it is never right to dogmatically apply policy in every case regardless of the particular circumstances of that case.

A good appeal decision this week. We applied to change a large terrace house in Swansea into a 7 person HMO. The Council refused the application under pressure from Members who are very keen to implement their new policy designed to limit the numbers of HMOs in the City. The Inspector accepted our arguments, however, that the property had previously been converted to flats and was in a bad state of repair and that the previous owner had failed to find a buyer because a renovation for single family purposes was simply unviable. A victory for common sense, therefore. Hopefully when the neighbours see the high quality conversion that I know my client will produce then they will not be so concerned.

CDN have recently had great success appealling 4 refusals from The City and County of Swansea regarding the change of use of dwellings (Class C3) to HMO (Class C4). These successful results form part of an ongoing trend for Swansea Council to refuse almost every HMO proposal. The City and County of Swansea in conjunction with the Welsh Government are publishing an updated Masterplan for the city centre, that has been prepared by a team of consultants. This takes the form of a draft Strategic Framework – updating a previous version that was published in 2007. The 96-page document covers an area stretching from the Railway Station in the north-east to the Civic Centre in the south-west, bordered by the River Tawe, Swansea Bay, West Way, Mansel Street and Alexandra Road.

We are pleased to announce that we have recently submitted a planning application for the installation of a 2.2MW solar farm on land near Treoes, in the Vale of Glamorgan. The application is on behalf of our clients Sybac Solar International GmbH, who are a German company beginning to invest in the UK market.

The scheme will involve the er****on of around 9,000 solar panels on frames that are piled into the ground. These panels will have a generating capacity of 2.2MW, which is equivalent to the annual average usage of around 630 homes. The solar farm will be connected via underground cables to the existing electricity grid just outside the site.

It is the intention of Sybac and the landowner to create an ecologically-friendly solar farm, which will involve new hedgerow planting and the sowing of species-rich seed mixes. The fields around, between and underneath the solar panels will continue to be able to be grazed by sheep.

A decision on the planning application is expected to be made by the Vale of Glamorgan Council later in the spring.

CDN Planning are pleased to start the new year with a planning permission from Carmarthenshire County Council. A planning application to change the use of a detached house to a House in Multiple Occupation was submitted in the summer of 2014. Although the application was recommended for approval by planning officers, it was called-in to committee by the local Member. At October’s planning committee Members voted to defer their decision until they had undertaken a site visit. This took place in January 2015 (nothing like a speedy and swift planning system…!) and at the subsequent committee meeting Members voted unanimously to grant planning permission, despite intense objection from the local Member. The applicant – and no doubt his student tenants – is “relieved.”
