COMMERCIAL DRONE USE AND PERSONAL PRIVACY

People are quite rightly concerned that drones, or as they are otherwise known, Unmanned Aerial Vehicles (UAVs) may be used to take film or photographs of them or their property without their permission.
Drones are covered by the General Data Protection Regulation (GDPR) and as such they are treated in much the same way as CCTV systems.

BAM Site Solutions is registered with the Information Commissioners Office under our trading company BAM Construction Ltd (Registration Number: ZA397841) we operate under a CAA permission and with CAA qualified drone pilots
We fully comply with data protection laws, but if you have a complaint or any concerns that you or your property may have been captured on film by a BAM Site Solutions drone, please contact us with the time and place of the event and we will take every reasonable step to ensure that any unnecessary images caught by us are deleted in line with your rights under GDPR.

It should be noted that when flying we are not always filming or taking photographs. The camera will often not be recording. In accordance with the code we only film or photograph what is necessary in order to prevent us capturing footage of what is not required

Privacy notice about how and why we use Drones:

a) What is BAM’s purpose of using Drones?

BAM needs to be able to track the progress of building on sites visually. This information is used for:
• Communication to staff and local residents
• Client progress reports
• Assessing time and progress of sites, identifying delays and potential health and safety issues
• Producing 3d models via point cloud software.
• Building inspections e.g. roof inspections.
b) On what legal basis do we process personal data for this purpose?
The processing of your personal data is based on the legitimate interest of BAM to process personal data necessary in the regular course of business of BAM.

c) Which personal data do we process for this purpose?
It is not intended that any personal data will be collected during drone filming, however, the drone imagery may temporarily collect images of individuals, both BAM staff and members of the public. Any identifiable images collected will be anonymised. Drone usage is subject to strict procedures governed by the Civil Aviation Authority. BAM operate under a CAA permission and with CAA qualified drone pilots. The CAA permission is renewed annually.

d) How long do we retain your personal data for this purpose?
Any identifiable images captured of individuals will be pixilated and anonymised. This will be completed within 7 days of the original footage being captured. The original footage is deleted securely and not shared. Live streaming will not take place.

e) Who has access to your personal data?
Any identifiable images will only be viewed by the drone pilot during editing. Only edited footage is shared for use by BAM both internally and externally; our clients; and/or stakeholders.

f) How is your personal data secured?
In the unlikely event that images are captured where individuals are identifiable these will be anonymised using pixilation. BAM will erase the original non-pixelated version.

g) Questions or requests for access, correction and removal?
