In private practice, I have had the privilege of sitting on both sides of the table in debt recovery matters. In one breath, we represented banks as plaintiffs seeking to recover loan facilities. In another, we defended customers usually business people against banks.

It is not easy on either side.

Over the years, one thread has consistently emerged:

The customers who are “very known,” overly comfortable with staff, or treated as internal friends often present the most complex recovery situations when facilities go bad. They tend to become the most difficult cases for banks.

From the trajectory of these matters, you often realise that at some point professional distance faded, credit governance became subjective, emotions clouded objectivity and proper due diligence weakened.

On the other side, for customers, desperation for access to finance often leads to one costly mistake: not reading and understanding the loan facility documents properly.

So here are a few lessons from both sides:

For banks:
1. Professional distance must always matter.
2. Credit governance must remain objective and disciplined.
3. Routine reshuffling of relationship management roles can help prevent emotional lending.

For customers:
1. Never sign banking or loan documents in a rush simply because you need the money.
2. Urgency is not a legal defence.

Once your signature is appended, the law raises a presumption of validity and consent. Rebutting that presumption is possible, but it is uphill and deeply fact-sensitive. Even the strongest defence lawyer cannot easily undo what a signed document has clearly expressed.

Access to finance is critical for growth.
But discipline in documentation is equally critical for survival.

Having worked on both sides, I can confidently say:

Debt recovery is not just about money. It is about structure, governance, documentation, and foresight.

The best disputes are the ones that never arise.

The Dean of the University of Ghana School of Law, Prof. Peter Atudiwe Atupare, has paid an academic visit to Southeast University in Nanjing, China, from 7th to 9th June 2026.

During the visit, Prof. Atupare delivered a lecture on Human Rights and Development, exploring the role of cooperation between China, Ghana, and other Global South countries in advancing legal scholarship and development.

The visit also provided an opportunity for meaningful academic exchange and discussions on strengthening collaboration in human rights research and education.

This engagement reflects UGSoL's commitment to fostering international partnerships and advancing global academic cooperation.
