1. WHAT : Armed encounter which resulted to the death of a robbery suspect.
2. WHERE : Along P. Burgos St., near corner Kalayaan Avenue Barangay Poblacion, Makati City
3. WHEN : At about 10:55PM of June 09, 2023.
4. WHO : Suspect James Aviles alias Pogi and a resident of Oro B Sta. Ana, Manila (Deceased)
Pieces of evidence recovered: One (1) Motorcycle color red and black with plate No. NO40327, One (1) caliber 9mm pistol with serial No. GA912202779 with two (2) magazines loaded with nineteen (19) ammunitions.
Responding police officers PCpl John Miranda, Pat Edreb Daub, Pat Peterson Rivera, Pat Madrogaba and Pat Marlon Sejas on board mobile car, all personnel of Poblacion Substation, Makati City Police Station.
5. HOW : At about 11:20 PM of, 2023. Personnel from Station Tactical Operation Center (STOC) of this police station informed this office about the suspect in a robbery incident, who was encountered by the elements of Poblaciรณn Substation, Makati Police Station.
Taking cognizance of the said information, PCPT ANGELO MENDOZA, PEMS Jason N David, PMSg Glen Marvin Gallero, PSSg Haje Usop and PCpl Rosendo Glodo of this Investigation Branch onboard Mobile car KO2 proceeded to the said place. Thereat, it was learned that unidentified male suspect was already been brought to Ospital ng Makati in Pembo for medical treatment of gunshot wounds sustained on his body, but pronounced him Dead on Arrival (DOA) at about 11:10PM by attending physician DRA. KARLA JEAN G KIM.
Upon inquiry, it was gathered that above named suspect was sighted along P. Burgos St., Barangay Poblacion, Makati City on board his driven motorcycle with covered plate number, who was reportedly involved in series of robbery incident roaming around the place. At this instance, when the above named police officers approached the suspect, the latter immediately sped off his driven motorcycle that prompted the police officers to chase the fleeing suspect, where he was cornered at the said place and when the police officer about to accost the suspect with the helped of concerned citizen, the latter suddenly pulled out his firearm and fired shots towards the police officers, who traded shots by defending themselves, hitting the suspect on the different parts of his body.
Injured suspect was later brought by the police officers to Ospital ng Makati in Pembo for medical treatment of injuries, but unfortunately, he was pronounced Dead on Arrival (DOA)
Suspect was later identified as James Pogi who was also involved in a Murder case, with No. DC20-INV-23 MAY-0010, filed before the Makati Prosecutor Office dated May 26, 2023 and through background check found out that suspect had several standing Warrant of Arrest .
Makati SOCO led by PMAJ GERALD VILAR with his personnel arrived at the scene and conducted the technical aspect of investigation, where they recovered from the crime scene four (4) fired cartridge casing believed to be came from 9mm pistol and same will be subjected for crossmatching examination to the previous offense he committed involving the said firearm.
