In the matter of Taxi Regulations Act 2013

MD Rahman -and- the Commissioner for An Garda Siochana (441JR)

The Judgment in respect of the above matter was delivered today by J Simon which has brought some clarity to the law.

IMK Law Solicitors brought the most number of cases similar to Rahman for clients against the Commissioner of An Garda Siochana whose applications for SPSV were refused on the basis that they only held temporary immigration permissions. In addition, we also pleaded that the Commissioner was incorrect by issuing a license valid for less than a duration of 5 years as the duration of license is governed by Regulation 7(3) of the Act which explicitly provides for a period of 5 years duration.

The crux of judgment is following:-

1. The Commissioner was incorrect by issuing a license which is valid for the duration of less than 5 years.

2. The Commissioner was also incorrect by refusing to issue a license for holder of temporary permission.

3. An applicant who is alleged of marriage of convenience can be deemed as a person not suitable and considering the finding of the MOC was valid consideration.

All the applicants who have been issued with a license for the duration of less than 5 years are invalid and they should be reissued with licenses for the duration of 5 years.
