Hon'ble Delhi High Court held that where the wife under divoce petition has made categorical assertions that with respect to cruelty and desertion by Husband and the Husband has alleged the same, then the Husband cannot undertake double standards of filing of Section 9 HMA (Restitution of Conjugal Rights) and the conduct showcases that the Husband never made sincere efforts to rejoin the company of the wife. Also, with the parties living separately for long time, it cannot be expected for parties in section 9 HMA to revive relationship after a long gap.
