In a significant case before the Delhi High Court, Monty Chadha — son of late liquor baron Ponty Chadha — has invoked the “Right to Be Forgotten”, seeking the removal of old news reports and videos linked to his 2019 arrest in a ₹100 crore property fraud case.
Although acquitted by the court in November 2019, Chadha argues that outdated media coverage continues to damage his personal reputation and professional standing. His petition names major media houses like Bennett Coleman, ANI, HT Media, NDTV, The Hindu, Indian Express, LiveMint, and Tribune, along with global tech giants Google, Meta, and X (Twitter).
Justice Purushaindra Kumar Kaurav has raised two critical questions:
- Is the “Right to Be Forgotten” legally enforceable in India?
- Can a petition filed five years after acquittal survive the law of limitation?
The case brings into focus the clash between digital memory, reputation rights, and media freedom. Chadha has also sought ₹2 crore in damages and an immediate takedown order.

Former Delhi High Court Judge Justice S.N. Dhingra, speaking exclusively to LawStreet Journal, clarified that the LG’s Video Conference Order is fully valid under the provisions of the Bharatiya Nyaya Sanhita (BNS).
He emphasized that allowing police officials to testify digitally saves both time and resources, making the system more efficient. The law itself permits digital proceedings, and embracing technology is the way forward.
Justice Dhingra stressed that timely justice should be the priority, and adopting digital methods in line with BNS will strengthen the justice delivery system while reducing unnecessary delays.
